Going to jail for self defense??

Did anybody watch Hannity and Colmes last night?They had this gentleman on for the second time because of support he is receiving from 100s of 1000s of people.The DA in Brooklyn is considering charges and jail time for his crime.His crime??Shooting a man(with a long criminal rapp sheet)that broke into his house.
The gentleman believed his live plus the lives of his children were in danger and he shot him twice with his legally purchased handgun.
The thug was only wounded and he collapsed in the driveway.Now the homeowner is in danger of going to jail and that thug will probably sue him.
Unbelievable !!!!!!!!!!!!

This is slightly misleading. As I understand it, his potential prosecution is for an having unregistered gun in New York, not for shooting an intruder.

It's still a disgrace, of course.

More of a disgrace because, AFAIK, he submitted the registration application beforehand. Can anybody confirm that?

No, very misleading and very wrong. The guy isn't being consider for jail time for self defense. I emphasize this because it is a twisting of the facts that is inaccurate and adds no credibility to pro gun folks showing they understand the laws and what is wrong with the system. Unfortunately, this gets done on both sides of the argument between pro and anti folks and such banter results in both sides calling the others names for not using proper "facts" and of course both sides are guilty of this.

The self defense issue is not in question in this case. It was self defense and there is no problem there.

What is wrong is that the guy kept an unregistered gun and it came to the attention of law enforcement because he had to use it. Why the guy didn't register the gun is beyond me, especially given the recent series of incidents in NY in the last few months were this sort of event has played out. People act to defend themselves legally, but do so with a weapon that is illegal as they don't have it registered.

Maybe the guy had submitted a registration form. Who knows? Still, even if submitted, that may not count as being registered yet.

If I were in his place and had an illegal weapon, I would have used it as well. It was a prudent thing to do in the situation, but with a high price.

Growing up, the next door neighbor had a fully auto tommy gun from his early days and it was not registered. Even so, it was what he kept as a self defense gun and said he would regret having to use it because it would get taken away and there would be a penalty to him. Even so, he lamented, it was the best possible weapon for his situation and it was what he would use. Fortunately, he never had to use it. My point here is that he understood the laws and rammifications and that was the gamble he was willing to take to save his life ... which is the bottom line.

I apologize for my misleading info.I thought I understood them to say everything was legal for him having the handgun.Alan Colmes was even fighting for him in his corner.
