Purchasing a firearm out of state for a Missouri resident.

Hello all.

I am a resident of the state of Missouri. What are the laws on buying a firearm from an out of state FFL?

I have seen that the consensus is that a handgun must be transferred back to your own home state and then an FFL transfer performed.

I am more interested in rifles. It appears that many states allow another state's FFL to transfer the rifle to an out of state resident.

Also, where is a good repository of Missouri gun laws?

You can go to any state and purchase a long gun from an FFL. The transaction must be done in accordance with your home state regulations.
They cannot mail you the gun.

Actually not. Missouri still has a law on the books allowing residents to purchase long guns only from contiguous states. This was done years ago to comply with federal law. The federal law has since been changed to allow purchase of long guns from FFLs in any state, but Missouri law remains unchanged. There is a bill this year to repeal Missouri's outdated law.

Can you please cite the source you got this info from? I really want to make sure I comply with laws, but I need to know them first.

Bubba613 and bhk are both only partially correct.

You, as a Missouri resident, can purchase a rifle or a shotgun from an FFL in ANY state, so long as the sale of the rifle or shotgun conforms to the laws of both the state the FFL is located in, and your state of residence - Missouri. You will notice the Missouri statute that bhk posted prohibits nothing. The contiguous state requirement in Federal law was done away with in 1986.

For example, if a Missouri resident purchases a rifle or a shotgun from an FFL in Washington state - no WA, MO or Federal statute is broken.

I can see very little difference between 407.500 and 571.085


407.500. Residents of the state of Missouri may purchase rifles and
shotguns in a state contiguous to the state of Missouri, provided that such
residents conform to the applicable provisions of the Federal Gun Control Act of 1968, and regulations thereunder, as administered by the United States Secretary of the Treasury, and provided further that such residents conform to the provisions of law applicable to such purchase in the state of Missouri and in the contiguous state in which the purchase is made.

571.085. Residents of the state of Missouri may purchase firearms in any state, provided that such residents conform to the applicable provisions of the Federal Gun Control Act of 1968, and regulations thereunder, as administered by the United States Secretary of the Treasury, and provided further that such residents conform to the provisions of law applicable to such purchase in the state of Missouri and in the state in which the purchase is made.

The only difference I see is that with the new law 571.085 it appears to allow both handguns and long guns. Am I reading that correctly?

Yes that is correct. Keeping in mind that Federal law prohibits you from receiving a non-rifle or non-shotgun from out-of-state, either from an out-of-state private party or out-of-state FFL. This prohibition includes handguns, pistol grip only shotguns, and stripped receivers.
