Active duty military and state residency

I couldn't answer this one and need some help.

My SIL and daughter are both active duty Air Force and just returned from many years overseas. They are stationed at DM in Tucson. My SIL, of course, has not been actively buying any guns for years now and the first thing he wanted to do was add several items to his gun safe. He is a Montana resident according to his D/L.

He went to a gun show this past weekend and was refused because he was not an AZ resident. I told him that was a good thing because they were going to hose him pretty good.

So my question is can he buy guns legally in AZ at a dealer or gun show?


Can he do FTF in AZ legally? I have no idea what the FTF requirements are in AZ.

Yes and Yes. Active duty ID card + permanent orders to a state = residency in the state ordered to, for the purposes of firearms transactions.

IDENTIFICATION OF TRANSFEREE
27 CFR 178.124: FIREARMS
TRANSACTION RECORD
Licensees may accept a combination
of valid government-issued
documents to satisfy the identification
document requirements of the
Brady Act. The required valid government-
issued photo identification
document bearing the name,
photograph, and date of birth of
the transferee may be supplemented
by another valid, government-
issued document showing
the transferee's residence address.

A member of the Armed Forces on
active duty is a resident of the
State in which his or her permanent
duty station is located, and
may satisfy the identification
document requirement by presenting
his or her military identification
card along with official orders
showing that his or her permanent
duty station is within the State
where the licensed premises are
located.

Like the sales guy at a gun shop said, show me your ID, orders, cash, and welcome to the free U.S.A., and take your pick of any gun you see in front of you without a sold tag.:)

I even keep a copy of my orders in my wallet. Then I have everything I need. And as always, anyone in the military should be keeping multiple copies of every important document.

I would have expected Arizona, especially around Davis-Monthan to be familiar with dealing with the military.

Must have been a newbie or a dummy.
