Open carry in the stands at the Daytona 500 isn’t that considered a “public event”. We need to get rid of that public event BS next. How are the outlaw motorcycle gang members; all with prior records so the sheriff was saying getting a CWPs to begin with?

I don't know what "compromise" the Senators have in mind. The Officers are simply against open carry. They were even against open carry with the special holster and ID requirements.

In order for this bill to pass, they will have to go against the police organizations. I have my doubts they will do that.

every LEO was against it. and yet they claim " i'm a member of the NRA" but i dont support this bill. they should be banned from the NRA membership.

The Rules Committee is chaired by Sen. Thrasher with Sen. Alexander as the VC. The "If Received" is in relation the the 3-day requirement the RC has to review the bills prior to their meeting. If it doesn't make the 04/15/11, it may goto the next meeting. Challenge is, conference committees also begin later this week or next week. Article about the "cop bashing" that went on yesterday. Cops bashing our rights that is.

Hillsborough County Sheriff’s Office Major Ken Davis told of a recent traffic stop of six Tampa Bay Outlaw motorcycle gang members. “Although the six Outlaws were certified gang members, and had histories of criminal arrests, most were also concealed carry permit [sic] holders”, he related.

According to Florida Statute, the Department of Agriculture and Consumer Services must suspend the licenses of those persons arrested or formally charged with a crime that would disqualify an individual for a license until final disposition of the case, and a licensee who is under an injunction that restrains them from committing acts of domestic violence or acts of repeat violence. Finally, the agency must revoke the license of a licensee who have been found guilty of, had adjudication of guilt withheld for, or had imposition of sentence suspended for one or more crimes of violence within the preceding three years.

Outright misrepresentation of fact appears to be a tactic our sheriffs are willing to utilize to defeat SB 234. Volusia County Sheriff Ben Johnson testified that open carry would be evident in the stands at next year’s Daytona 500 auto race. Conveniently, Sheriff Johnson omitted the fact that carry at a professional athletic event is a violation of existing statute, and Daytona International Speedway is a privately owned facility and has the statutory right to have anyone trespassed from the property for any reason, including carry of open or concealed firearms.

Amazing I could figure out all this on the fly as it was happening and these guys who prepared for all this and are supposed to know the laws which they enforce obviously couldn’t figure it out.

Fl. sheriff's have such a spotless record: Okaloosa sheriff and several deputies under indictment for fraud and other misconducts, Escambia sheriff and city police under investigation and these are only 2 that I know of because I have relatives living there. I have a nephew that is a retired Fl. deputy and he said that politics and the good old boy club permeates the sheriff depts. throughout Fl.

I'm glad this seems to be moving forward. I did notice something interesting in the text of the bill, however. Lines 33 - 40 of the Senate bill read (emphasis added):

33 ........Any person in compliance with the terms of
34 such license may carry a concealed weapon or concealed firearm
35 notwithstanding the provisions of s. 790.01, or may carry openly
36 notwithstanding s. 790.053. The licensee must carry the license,
37 together with valid identification, at all times in which the
38 licensee is in actual possession of a concealed weapon or
39 firearm and must display both the license and proper
40 identification upon demand by a law enforcement officer.


This would seem to imply that when the weapon is NOT concealed, it's not necessary to have your permit in your possession and that you are not under any requirement to show it to a LEO upon demand.

wow idk I just got in an argument with with the guy behind the counter at a lgs today sayin the open carry was just for prining or accidental exposure. oh and Ed N. nice to meet you i'm in Haines City also.

He should read the bill. That's one of the arguments being used to promote it, but that's not what the bill says. The text is very clear that CCW holders may carry openly.

The bill says what it means and means what it says. Seems pretty simple to me.

I watched the Judiciary Committee debate. No one supported open carry in the general public. The only thing I heard was hiking in the mountain and having a gun for snakes and cougars. Therefore, when the opponents brought up the issue of open carry on the beach and restaurants, there was no response. That's why there's amendments being suggested to change it for the specific circumstances on which the sponsor emphasized on, accidental exposure. No one on the proponent side is seriously advocating for unrestricted open carry during debate.

Could you please show me a mountain and a cougar in Florida?

A housecat in Mt. Dora would be about as close as anyone could come to that.

I believe what was passed by Judiciary simply says CCW holders may carry openly.
