I'm in Maryland; want to buy out of state rifle

I'm in the grand state of Maryland, and I'm interested in a few rifles for sale here on THR. The rifles are in Virginia, and Pennsylvania.

Can I drive out of state and make a face to face purchase from a private seller (non-dealer)? Or do I have to have it shipped to an in-state FFL like we do with handguns?

I couldn't find a decent link to the info online, and even if I could, I probably wouldn't have understood it:confused:

Thanks for any info!

Federal law sez you can buy a rifle from a dealer in any state. Federal law sez you can buy a handgun from an individual only in your home state, or from a dealer in your own and in immediately adjacent states. After an out-of-state purchase, you're faced with whatever requirements Maryland has.

Now: With the changes in the federal laws, I'm not sure about individuals selling rifles or shotguns to a non-resident individual. Used to be, it was legal.

as far as i know, dealers in VA can sell to LONG GUNS to people that come to their store from MD, WV, and i beleive NC.

I believe that is still correct, cookhj. However, the question concerns private sales. Federal law strictly prohibits the private sale of any firearm to a non-resident of the seller's state. (Source is "Virginia Gun Owners Guide" - Bloomfield Press.) The firearm (handgun/long gun) must be shipped to an FFL in your state, Maryland. Or you might be able to do the sale in person at an FFL's place of business in the sellers state.

I love these laws. Clear as mud.

So, if I live in occuppied **********, can I buy an AR15 rifle from a dealer in Arizona and store it in Arizona for monthly visits to the desert for shooting?

... but only from a dealer, or from a private person by going through an FFL holder.

the Maryland code only states that
it is legal for a Maryland resident to purchase
a long arm in an ajoining State from an FFL

i see no mention of private sales of long arms

regulated arms (pistols and "Assault weapons")
must be transfered to an in state dealer for logging
and private sales are to be done at the State Police

It's not a Maryland law, it's a Federal law. (Title 18->Part 1->Chpt 44->Sec. 922) (http://www4.law.cornell.edu/uscode/18/922.html)

i wasn't sure about the whole interpretation of the law and i didn't want to speculate on it.

to be on the safe side, you should just go through a dealer.

Yikes....I think I'll just stick to in state sales if for no other reason than to avoid the headaches and costs of shipping/ffl fees.

Thanks for the replies!

Which is exactly what they want you to do. Nothing.

Find a decent FFL who'll do the transfers for you. Even if he charges a couple of $$, that may be the only way to get some items here in MD.

Especially now that shell case and gun lock laws are in full effect, the handgun and regulated firearms selling prices here are jumping.

After a while, other prices may follow. If you can't get what you want in state, get it from out of state. You can always make more money, but you may not always be able to get some firearms.

Buy accordingly.

The old federal requirement that the state be adjoining went away years ago.

I have no idea what Maryland adds to federal law, however.
