short barreled shotgun NY

zeaken May 3, 2012, 10:46 AM I have been trying to do some research on the internet and found out it might be possible to get a short barreled shotgun in ny? The difference seems to be if its classified as an aow or sbs from what I can find out but maybe you guys can shed some enlightenment.
What I would like to do is get something such as a Serbu Shorty. I heard in NY they can be classified as being put on a pistol permit and you just have to pay the $5 tax stamp because its considered an AOW? I live in Erie county if that helps at all.
Any help you guys could provide would be of great assistance!

drsfmd May 3, 2012, 10:51 AM AOW's like the Serbu are ok if you can get the judge to add them to your permit.
SBS are not ok under any circumstances.
zeaken May 3, 2012, 10:59 AM Thanks.
Does it need to be the local judge or can it be any local law enforcement chief? The only reason I ask is because Erie county is not a very pro gun area as the judge only tends to issue permits with "hunting and target" on them (including my own currently) and I fear he would not smile down upon such a request.
EmGeeGeorge May 3, 2012, 11:27 AM Erie county?
Good luck, better start sending contributions to the next Sheriff Elect.
drsfmd May 3, 2012, 11:33 AM Unless they do things differently in Erie county, it's the judge that signs off on the pistol permit amendments, not a CLEO. You may very well be out of luck.
zeaken May 3, 2012, 12:19 PM yeah its the judge so i would have to get it through him. Has anyone ever heard of some one getting an AOW in ny even? little less erie county itself? Just debating how much effort is worth putting into it at this stage.
Sweden May 3, 2012, 12:55 PM Point of note, your tax stamp will be $200 unless the weapon you are buying has been previously registered in NY.

No.
It's $5 for transfer, $200 to make. It doesn't matter where the weapon was xferred into his NY FFL/ SOT from. See the pattern:
MFGR registers it on a Form 2 (free)
XFER to FFL/ SOT in NYS on a Form 3 (free)
XFER from FFL/ SOT to you on Form 4 ($5)
_____
MFGR registers on form 2 (free)
XFER to local non-SOT customer on form 4 ($5)
XFER from non-SOT to local FFL/SOT on form 4 ($5)
xfer to you NYS FFL/SOT on form 3 ($0)
XFER to you on form 4 ($5)
____
Non SOT registers/ makes SOT on approved form 1 ($200)
XFER from that person on form 4 ($5)
____
Register/ make AOW on Form 1 ($200)
Prince Yamato May 4, 2012, 11:17 AM You could probably get the judge to sign for it as a curio. You're probably not going to get it as unrestricted.
There are people in NYS with aows. You see them post pics on gun forums from time to time. They're not impossible to get in NY, they're just very uncommon.
