McDonald's Posting?
"No Concealed Weapons" signs are appearing on McDonald's doors in eastern and central Missouri and may include several franchize owners. The signs appear corporate in nature and are on the same small banner than prohibits no shirts, no rollar skates, etc. Have others noticed this in other areas of the country, and does anyone know if it is really cooperate in nature?
I really don't enjoy eating there much, but I consider these postings significant and maybe a stink needs to made of it.

Yeah, sounds like a corporate thing, or even a "franchise-corporate" (when one corporation -an incorporated company-) owns franchises of another. I don't know if those have the "power" of law in Misery, uh, Missouri.
If that happens in Florida, I'll be in violation a lot. I do most of my grocery shopping there.

^ Remarkable. I've never seen one in a Miami area McD's. I just checked with my 3 hamburger addicted daughters who visit many of their locations every week and they have not seen one either.
McDonalds is normally more intelligent that this stupidity, of which bhk and mesinge have informed us is happening in at least Mizzou and Central Florida.

It is nice that McDonald's also admits there is nothing inside the store that can rationally be considered "food"...

That's funny: No food, no photos, no firearms. Somehow I feel safer already at the arches.
Well that used to be my favorite place to meet for FTF deals where we would both sit and have a cup of coffee before doing a deal. I guess I need to find another place to meet now. :neener:

I'd suggest Starbucks. I myself hate their coffee but they're 2A friendly (still, i think).

Nothing bearing this signage at our local Mc'ds here in JC, Oregon. It is a corporate store to the best of my knowledge.... it doesn't have all the franchisee stuff posted.

My brother and I used to work at McDonalds, we see people open carry and CC (we can see them print :rolleyes: ) all the time here in VA

You almost NEVER see signs like that in the South except in places like the hospital, court house and post office. I can think of only ONE private business with a "No Guns" sign in my city. It is on the door of a pawn shop that does not sell guns.

Or a photo of a no guns sign at a Toys R Us store rather than a McDonalds? I just don't see that sign at being at a McDonald's. Toys R Us, which is what the file name is labelled, makes much more sense.

Good question,Navy. But we (myself,wife and 3 grown daughters have never seen a Toys RUs posted in the Miami area either. Not to say they are not posted in some locales.

I am not a lawyer, and the interpretation of laws are subject to court review, however Gutmacher discusses trespass and armed trespass in Florida in some detail.
Once you are warned by someone with authority - you must leave... A mistaken trespass is not a "trespass" until the warning to depart occurs.

My understanding is that the sign posted at the restaurant/business establishment in this case does not have the weight of law in Florida. The following situations could arise:
A) you enter with a concealed weapon, conduct business, and leave.
B) you enter with an open-carried weapon (illegal in Florida anyway, except when traveling to or from a campsite, fishing, or hunting) conduct business, and leave.
C) you enter with an open-carried weapon (violating state law), are asked to leave, and now must leave or risk committing armed trespass.
D) you enter with a concealed or open carried weapon, are forced to use it in self defense because you are in fear of your life, and trespass laws may not have anything to do with it. Instead, the focus will be on the situation and justification of force for self-defense.
In Florida, you can carry anywhere not otherwise prohibited by State or Federal law/statutes. Cities, counties, and districts do not have the right to prohibit firearms or risk violating state laws themselves. That said, the state has made it clear that the preferred method of carrying is concealed and with a license.
So basically, regardless of the sign (most of which I do not read anyway. Nor do we sign anything saying you consent to the terms, understand the terms, know of the terms, agree to the terms) in Florida you would have no legal issue concealing in such an establishment, provided you left if asked to leave, which remains true on any private property based on trespass law. FYI, it is illegal for security guards or anyone else to detain you unless you refuse to leave. You do not have to do anything but leave, and then only if asked. Seems like I'd rather risk being asked to leave then traveling unarmed due to a random piece of paper posted on a wall. I do however advise complying with state and federal regulations on this subject, and do your best not to antagonize business owners if it can be avoided.

I would assume that the postings are made by individual franchisees who own the stores in question.
It is possible that pressure at a national level could be brought to bear on the franchisor (McDonalds Inc.) to adopt of friendly 2nd Amendment policy and inforce it upon all franchisees.
The gun-grabbers will stop at nothing to take our freedoms away and this is wrong.

The McDonald's website says 80% are independently owned franchises. I would guess that each owner could have his own policies and make their own "who do I serve" decisions. While I would support the business owner's rights to decide not to serve armed individuals. I would also support the rights of armed individuals in deciding which businesses they frequent. Besides, if they cant see it they aint gunna know.

The Toys R' Us thing makes more sense. The sign shows no logos either way, but the context makes more sense for a Toys R Us. Most restaurants so no "outside" food, etc, rather than no food. Also, for whatever reason, many people feel that pedophiles frequent Toys R Us stores which might explain the no photos thing. I'm not sure that the situation is true in reality, but posting up signs sometimes can sooth people's fears.

I don't think any sort of sign has any legal weight in Missouri. All someone can do is ask you to leave and if you don't leave you can get fined 100 bucks. I would keep my gun concealed and not worry about it.

That's my fault. I saw a sign a Toy R' Us about a year ago I think and that's this photo. I took a pic of the one at McDonalds as well, as I usually snap a pic of these, and I must have confused them when I Hotlinked it here. Let me try to find the right one.

I don't consider bread and 100% beef to be lots of soy or grease or to not be food.
Maybe there's some confusion with the percentage of dirt that was reported to be found in the meat at Taco Bell.
Why attack the restaurant's food in a discussion about a sign?
That not only doesn't garner any support from folks who happen to like their food, but it insults all of their customers and appears to be false.
So why try to insult all of the people who choose to go there to eat?
That would seem to me to be disingenious and using the wrong strategy to promote the 2nd amendment.
If someone doesn't like their food, then fine.
But their beef is not soy. :rolleyes:

My understanding of the Missouri law is that unless it is a lawfully prohibited place all that can be done is you can be asked to leave. If you do not leave then you can be charged with trespassing. Lawfully prohibited places include Post Office, Sporting events with over 5000 seats, Casino's etc.
