to respond to all you who responded to my last thread i was not carrying the weapon i took it upon myself to pull way off on the side of the road to sleep some more this state route happened to pass through an indian res .the cop woke me up like an hour later and i made me get out of the truck i blew a point .08 exactly and they still charged cuz car was running but it was freakin 100 dagrees outside i was running the ac anyways yes DUI very bad i learned my lesson its been over a year now i did my timed in jail paid all my fines all 1700 $ and yes the indian pd still has the weapons before anyone asks.
the weapon was in the car with my shot gun wich ive already recovered from them because i had the bill of sale for that weapon the evidence tech just wants a bill of sale and my two forms of id the process i just went throught with my shotty but i having a hell of time tracking down the previous owner aside from driving to tucson and trying to remember where he lives knockin on his door wich is what im planning to do monday morning
so to clairfy some more and save me a trip of driving to tucson and trying to remember how to get to this dudes house is there an easier to track the previous owner down with the weapons serial number and does anyone know if arms list keeps any kind of records ?

Not trying to be rude but it has been a year, you have paid $1700, and is was a common $600 gun. I would just move on and let it go. As posted in the other thread a lawyer will cost you more than the gun.
Buy another one, they are easy enough to find

As I see it, you basically have two options that won't cost more than the gun is worth.
1) Threaten to report it stolen if it is not returned post-haste. You'll need to know the S/N to do this, though.
2) Take them to small claims court. Minimal filing fee, no attorney needed. You will, however, need to somehow show that you owned the weapon.
I'd go route #1 myself. I had an airline lose my handgun not so long ago. I tried being nice, but after a day, I told them if they didn't find it, it would be reported stolen and they could have fun with each one of their baggage handlers and terminal personnel being checked out. Whaddaya know? It turned up about an hour after that phone call.........

Now that you've shared all the story, this gets easier to answer. If you have the serial number, a hand-written receipt showing when you bought it should suffice. Being that AZ allows FTF private-party sales, it doesn't matter who the gun was originally registered to - it could have passed through a dozen owners before you bought it from your buddy a couple months before your arrest. You were not charged with a gun-related crime, so the property clerk is simply following policy.
Now think back a couple months before you got arrested - which of your buds sold you that Glock they won in a poker game? Go have him write you a copy of that receipt....the burden of proof is on the property clerk, and he just wants a copy to cover his a$$. Be extra nice, and take him a photocopy along with your original. Making his job easier can only help.

To answer ArchAngelCD, yes a DUI is a non violent misdermeanor. It has no effect on legally owning a firearm. A sheriff or CLEO can refuse to issue a pistol permit if the state requires you to get a permit. I know a couple guys that had DUI's in the past and now were approved foe CCW.

Sounds like it is his gun. Why give it to a thief?
File in small claims or whatever it takes. If the gun is worth $600 spend $600 to get it back...principle!!

If the DUI had a possible sentance greater than one year he is a prohibited person or am I wrong. Seem to remember another poster who got in a world of hurt over a DUI.

AFAIK, 1st (and second) offense are punishable by up to one year. But I believe 3rd makes you habitual and carries much stiffer penalties, including several years in jail if the judge sees fit.

Not sure what needed to be clarified in regards to the very excellent advice of "get a lawyer". Thus, this one is getting closed tas well because I see nothing that indicates that lawyering up is inappropriate or bad advice.
