MAN FIRED SHOTGUN TO PROTECT HIMSELF, COURT IS TOLD

A Gunman shot a man in the leg after firing two warning shots, a jury was told.

Mark Campbell allegedly fired into the air before deliberately shooting his victim.

Nottingham Crown Court was told an 11-year-old girl saw the incident in Sherborne Road, Broxtowe Estate.

She told police a man, who she was fairly sure was the victim, had said to Campbell "you owe me" when he arrived with others at the house in April last year.

Campbell, 20, of no fixed address, denied he owed him anything.

His mother, who was in the house called police, but when the victim allegedly damaged a car, Campbell went out with a shotgun.

The court heard the victim, who was not badly injured, had a handgun in the waistband of his trousers.

Campbell denies attempting to inflict grievous bodily harm, and the alternative charges of assault occasioning actual bodily harm and possession of a firearm.

He said he was acting in self-defence.

Wayne Jordash, defending, said the incident had echoes of farmer Tony Martin's case, where he had armed himself with a gun to protect himself from burglars.

"He [Martin] has shot and killed that burglar," he said. "He was convicted of murder and that was reduced on appeal to manslaughter. An Englishman's home is his castle - creating a space where they can retreat and be safe.

"You may think, to a certain extent, for people to intrude on that safety, they take the risk of injury that may follow because a householder decides he or she defends himself."

He said he was not advocating anarchy but was seeking to argue that it was no different for Campbell.
