I know some people here are keeping up with income tax issues, Larken Rose has made his motion to quash and motion to unseal available at TaxableIncome.net (http://www.taxableincome.net/motions.pdf).

This includes an affidavit from his wife that gives a pretty good idea of what happened that day (from her point of view). Many people here will not be familier with his research, but that's not the important thing here. The IRS sent in JBT's and went on a fishing expidition for evidence, including measuring the barrel lengths on his rifles (something they have no business doing for starters).

Just another example of how some federal agencies abuse their authority, and none of the rank and file stop to question it.. 'just following orders' no doubt.

Regardless of what you might think about the issues he raises in relation to Title 26 USC, I think everyone would agree that he has a right to do so. Hopefully he'll have the affadavit posted in a few weeks, perhaps there's something we don't know. Of course considering it's been 9 months since and no charges have been brought, I doubt they've got anything... and not for lack of trying.

At times I wonder if I'll get one of these, simply because I keep sending letter (to IRS, IRS Taxpayer Advocate, my Senators, Congresscritters, etc) asking a few simple questions about the law.. and all I get back are threats and assertions with no valid basis (exactly like many others that try to get a straight answer from the Feds on any issue).

There is something seriously wrong here, and I don't think it's going to get any better.

An ugly situation to be in.

IANAL, but...

It's a bit odd that the motions don't mention Groh v. Ramirez (02-811) (http://www.thehighroad.org/showthread.php?s=&threadid=48237). From a fairly cursory reading of that USSC opinion, warrants which don't include or reference the affidavit are a very definite no-no. The difference between that case and this one is that the IRS agent was apparently somewhat (but not very) specific about what he was looking for.

It'll be interesting (in the old chinese sense) to watch this from a distance. I hope things turn out right for them though.

It seems they referenced enough decisions though.. It just chaps my behind when this kinda thing goes on, for all we know it could be daily.. just never reported (kinda like 'man points gun at burgler, burgler leaves' stories..).
