A state employee was accidentally shot in the thigh Friday by an off-duty security guard showing his weapon to a hot dog vendor.

Security guard Mark Cawl, 49, who has a permit to carry a handgun, told police he was waiting for a bus to take him to work when he pulled his 9 mm pistol from its holster to show the hot dog seller, according to state Trooper Anthony Davis. "He was showing me the gun and it went off," said the vendor of Mikey's Red Hots hot dog stand, who wouldn't give his name.

Charles Harrison, 56, an assistant to state Comptroller John Morgan, was crossing the street on his way to work when he was struck by the bullet. Harrison is expected to be released from Vanderbilt University Medical Center later in the day after treatment for a wound to his right thigh, hospital spokesman John Howser said.

Police confiscated Cawl's gun but didn't charge the guard because the shooting was classified as accidental, police spokesman Don Aaron said. However, the case file will be submitted to prosecutors for grand jury consideration.

"ACCIDENTAL"!!!! Who was handling the firearm when it discharged? NEGLIGENCE!!! That is what we are talking here. He was showing his firearm to the hot dog man and shot someone?

Update:

Victim: released from hospital, expected to be back to work next week.
Negligent guard: DA still ponders charges, at present considers it an accident.
Vendor: some folks ran over to the victim - "I stayed here and served hot dogs; I don't know nothin', I'm just a hot dog guy."

An off-duty security guard who shot a state employee while showing his weapon to a hot dog vendor has been charged.

Mark Cawl, 49, was arrested Friday night and charged with aggravated assault and reckless endangerment in the Jan. 31 shooting, police spokesman Don Aaron said. Cawl told police he was waiting for a bus along Deaderick Street downtown when he pulled his 9 mm pistol from its holster to show to the vendor. The weapon discharged and struck Charles Harrison, an assistant to state Comptroller John Morgan, in the thigh.

"Although Mr. Cawl had a valid handgun carry permit and a valid security guard license, he nevertheless was reckless in handling the gun on that street corner," Aaron told The Tennessean.

Cawl was working for Security Services of America.

Harrison, 56, was treated at Vanderbilt University Medical Center and still has the bullet in his thigh.
