We need to push for MORE Firearm Rights

We need the equivelent of incorporating the Second Amendment Rights to the Civil Rights and Voting Rights Act.

We need to be pushing for REMOVAL of restrictions that impair our ability to defend one's family, one's self and one's society and nation. Far too long have we allowed certain members to attack and deny our rights. It is no different than how the Democrats fought tooth and nail to prevent full rights to Blacks. No different than how Democrats fought tooth and nail to prevent Voting Rights.

We should be demanding the legislative teeth to back up Heller and other rulings.

1) Incorporate the express desire to excercise one's Second Amendment Right as a Federal 'protective class' with strict strutiny applied to any and all related laws.

2) Mandate that anyone, anywhere who can lawfully meet the requirements as on the current 4473 must be allowed to purchase any lawful (non-NFA) firearm. Any additional restriction must be viewed as a violation of Civil Rights with several legal and civil penalities.

3) Mandate that any 'ID', "card" "permit" etc be 'shall issue' to all citizens who meet the test of 4473. Any fee, tax or associated cost to obtain said ID must be treated as a "Poll Tax" and criminalized as a violation of Civic Rights. Any additional restriction must be viewed as a violation of Civil Rights with several legal and civil penalities.

4) Mandate as a Maximum requirement of a "Shall Issue" open and concealed carry permit. No requirement to exceed the requirements of 4473 can be required; except for an NRA or other designated pro-Second Amendment Group's safety training, not to exceed 8 hours, which must be offered enough that any citizen can reasonably attend within 2 weeks, and 25 miles. The state "Shall Issue" said ID, Card, Permit within 2 weeks after completing said class. Any and All costs shall be born by the State. Any additional restriction must be viewed as a violation of Civil Rights with several legal and civil penalities.

5) Mandate that the full protections of the "Full Faith and Credit Act" apply to all issued ID, Card, Permit etc. Any additional restriction must be viewed as a violation of Civil Rights with several legal and civil penalities.

6) Mandate that any and all "Free Kill Zones" be absolished, except for designated Secure Government Facilities, which will require continuous 24/7 Armed Police Officer or Other Government Security [Not Private]. Any additional restriction must be viewed as a violation of Civil Rights with several legal and civil penalities.

7) Mandate that simply posessing or carrying a firearm of any type is NOT resonable or probable cause of a crime being commited.

8) Mandate that any lawful citizen who meets the requirement of 4473 will have inherent Standing, to sue any level of government, official or agency for any violation of these Civil Rights.

Unfortunately, you and I know when the politician says "Everything on the Table", they are speaking out of their sphincter.

At the same time, it should be realized, that we have had nothing but positive momentum for quite a while now. Just because it isn't happening as fast as we want it to doesn't mean it isn't happening.

The last holdout state on concealed carry has been overturned. The right to keep and bear arms has been ruled to be an individual right, and has been incorporated. Keep an objective view.

Some pro-gun Senators should introduce something like this as soon as possible, if for no other reason than to be a counterpoint to Feinstein's bill. OK, the antis have laid their maximalist cards on the table; now it's time for our side to do the same. If you have no position going into negotiations, the other side gains something simply by default. BTW, let's not think small -- go for complete repeal of the NFA. If Feinstein is unreasonable, we can be "unreasonable" too.

I'll do one better. Abolish the NFA registry. The whole thing was contrived to solve a problem that no longer exists, the violence caused by the government in its pursuit to dry out America. Values of NFA items will stay high because there are buyers at current price levels so they won't drop much, if at all. And I highly doubt you local hoodlum wanting to knock offf a liquor store is going to drop $10,000 on a MG. Maybe $125 for a Hi-Point.

I do agree with equating this to the Civil Rights Act. Push for full constitutional protection, not just allowances.

MLJdeckard,
The further problem though is that you have states like CA and others that are NOT a shall issue for the CCL or CPL. Some sheriff gets to decide if he wants to give the license or not and in most cases doesn't. This is not only ridiculous but is a need area of change.

Along this idea is the need for some standardized CPL nationwide. I shouldn't have to take 15 classes and become some resident to get CPL in a particular state. Set a standard for getting a CPL and then allow us to carry!

This mirrors my thinking exactly. Feinswine's definition of compromise is that she gets most of what she wants while we get nothing except a further erosion of our rights. Let's throw national non-permit CCW out there as the 'cost' of a magazine size limit and see what happens. After all, it's "for the children!"

FWIW I was a middle school teacher for 12 years. I can tell you I felt much safer once I had left the Gun Free Zone for the day than I did when I was in it!

'cept I don't think it's unreasonable to do so. VERY minimum should be the overturn of the Lautenburg amendment.

Feinstein is one old lady with a tired, failed solution.
The Biden commission - if they do their job right, will find the cause is mental illness, not guns.
Only time will tell.

Oh and repeal the gca of 68 nfa of 86 and that ban in 34.
