On the Glenn Beck program (conservative talk radio) they are discussing the 2nd Ammendment. Glenn posed a good question. Should doctors be able to say that a patient can't buy a gun due to medical illness, such as schizophrenia (sp?) i.e. Ohio area sniper.

NRA members have been calling in, making good points and representing gun owners fairly well.

What do you think about it?

BTW, this is the first talk radio show host since Limbaugh that supports the 2nd ammendment for its true reason...protection from government tyranny.

Dammit...the site requires a subscription to listen to it over the net...and I don't have a radio in my office.

You're already legally barred from purchasing a gun if you have been judged "mentally defective." It's on the 4473. My big problem with that is, what's to stop the state from getting a state-paid pshrink to say "Yup, he's a nutter."? At that point, what recourse do you have?

My standard statement on the "mentally defective" clause:

It makes sense to have a loophole for this, however.....

It needs to be the exact same criterion used to involuntarilly commit someone to a psych ward.

If you ARE a danger to yourself or others, you shouldn't be running around loose.

If you are NOT a danger to yourself or others, what's the problem?

The whole thing is predicated on a false classification:

That there are some people whose mental problems only make them dangerous if they should happen to have a gun. Otherwise, they're just fine, let 'em run loose.

In Louisiana, the coroner may petition a judge to hold an adversarial hearing after which the judge decides whether or not an individual is a danger to himself or others. This preserves our due process rights. Any process which didn't involve an adversarial hearing before a judge would not.
