Intruder fatally shot by apartment resident

A 20-year-old Rockwall man was fatally shot early Sunday when he entered an apartment after throwing a patio chair through a sliding glass door, police said.

Levi Shelton was shot once in the chest by a resident of the apartment in the 1100 block of Forest Creek Drive, police said.

Shelton was taken to Mesquite Community Hospital where he died, the report said. The two apartment residents were uninjured.

Police said the case will be referred to a Dallas County grand jury.

Investigators said Shelton had been at a party in an apartment building adjacent to where the shooting occurred. Witnesses told them that Shelton got mad, "threw a chair through the upstairs window" and "jumped from the balcony."

He then went toward the apartment where he was shot.
