Officer Whose Gun Discharged Will Not Be Charged
Accidently Fired At Bushnell Theater

HARTFORD, Conn. -- An off-duty Capitol police officer whose gun accidentally discharged at the Bushnell Theater will not likely face criminal charges, according to a Hartford police spokeswoman, NBC 30 reported.

No one was injured when the gun belonging to Paul Warren went off Sunday during a performance of "The Tale of the Allergist's Wife," starring Valerie Harper. But a bullet fragment bounced off the leg of Mary MacMullen.

Hartford police and witnesses said that Warren's gun discharged as he and his wife returned to their seats as the intermission ended. Warren was carrying his personal 380-caliber Browning automatic handgun.

The bullet was shot out of his shoulder holster and ripped through his sweater without striking him. It continued through the seat and hit the floor. Metal fragments struck the 46-year-old MacMullen of Enfield, Conn. She was sitting three seats from Warren. She described the impact as similar to a needle sticking her.

Theater patrons were evacuated and allowed back in after about 45 minutes.

The show went on.

Now, how did he do that? I always thought a shoulder holster would be one of the best ways to keep your finger off the trigger unless you really wanted it there...

Can anyone dig up a case where anyone was charged for a negligent discharge?
I am curious, because this case sounds prime for an endangerment charge to me.
Oh and ewwwwwwwwww, he was carrying a 380, but it was a Browning, so that redeems him just a little. ;)
