I have a Marlin 39 Century LTD Made in 1970, placed it on the fireing line for sale. The only response I recieved was from a man in California. He wants to pick it up at my home in Las Vegas Would that be legal? Thanks for any information.

Have to ship it to an FFL in his state.

What you are planning is illegal.

Rifles can be purchased out of state in a face to face transaction with a license holder. Face to face with out of state resident can not be done if you don't hold FFL. Must be shipped to a FFL in his state.

Because Congress said so when they passed the Gun Control Act.

There's also the possibility that the buyer is a Fed. If you decide to flip the BATFE the bird, they might reciprocate.

Can the individual ship to the FFL or does the individual have to ship to the FFL through a FFL?

Same restrictions on ammo?

The individual can ship directly to the FFL using a common carrier

Yes, but you will need a copy of the recieving FFL license signed in ink. Or, check with the carrier if they will simply accept the FFL number.

Such as UPS?

The post office might be easier than UPS for a private individual. If the clerk gives you a hard time, tell him/her to check the Domestic Mail Manual, section C024.
