NICS came back "delay"

I have only had 1 slow transaction, about 3 years ago. I had fought a misdemeanor charge that is NOT a disqualifying charge as long as I could fight it and then took a plea agreement to unsupervised probation. It obviously went to a person as the FFL changed his tone and started giving me weird looks. 5 minutes later he knew my legal difficulties and I was approved.

FBI NICS is prohibited from telling your dealer OR YOU the reason for a delay. The only person that can found out the reason for delays or denials is YOU, and they won't tell you over the phone, only in writing or online submission.
 
For me it, for some reason, depends on which LGS i buy from. I go to different ones based on availability.

My favorite LGS has gotten a delay the last 2 times I bought there. Came back proceed within 24 - 58 hours.

I can go to Academy and wait 30 minutes - tops.

Went to another store recently and they said the 3 day wait provision before you could deliver if no response had been temporarily extended by ATF, FBI or whomever sets those things to , I think , 10 days.

All due to back log of apps. They said every customer who had come in was being delayed at least 10 days.

Anyway i went ahead and bought a pistol and an AR lower. Filled out papers and got a proceed within 10 minutes. WTH?

About 20 people in the store turned around looking at me as if to say -"who Are you!"

Well the guy clearly said “misdemeanor” and “are you sure” while mumbling on the phone.

I can only hope that the half wits that voted in our last gun control debacle are STILL waiting for the guns they bought to protect their toilet paper.
 
The Florida background check service has been extremely busy for the past couple months. I had a 3 hour wait recently. They told my FFL dealer while he was on the phone (he knows a couple of them somewhat personally after so many years of contacting them) that in the same period (I think it was a day, which makes sense if you do the math on 2019 gun sales) they did 13,000 checks this year vs. 2500 last year.

Map is WRONG for Nebraska. "Firearm Purchase Permit" and Nebraska issued CC permit is considered to suffice the background check for long gun or pistol.

No, your governor doesn't hate gun owners, your governor is a senile wandering fool kept off the street, and out of traffic by the state patrol 24 hours a day. Now Sideshow Bob ferguson, Jay's nurse, and attack dog hates gun owners. I too miss buying in anacortes, but living in Birch Bay, I cant anymore... sorry for the politics. limiting buying to a region that is conveniently accessed is sleazy, last I check Seattle had 2 gun shops. Stan Baker, and Butches. DGS was just coming to Lakecity, but they're the mall celphone kiosk of gunshops. Pretty sad for a city of 1.8 million to have two 900 sqyare foot shops, and no option to buy outside your region.

A few years ago I had like three delays in a row. Their system may have been backed up due to Memorial Day sales.

It’s a federal holiday so people take off and often use vacation the Friday prior. Plus sales go up.

Don’t fret.
 
For the first time in my life, I almost hoped for a delay last night. Woulda made it easier to walk away. But, at 8:30pm on a Sunday, the NICS system must not be as busy and I ended up with a gun I don't need/want/care about. Except it was cheap and I can let newer shooters learn with something cheap that I don't care about.
Be surprised if you don't get ok'd in the next day or so.

No, map is correct. Note the " NE* "....that " * " means Nebraska has a permit that serves as an exemption.
 
Virginia has a state system.
I get approved in 10 minutes.
My my wife get delayed at least a day as she has the same name as last who was convicted of murder in Mathews County. The computer kicks it to human and I'm told they usually run at half the number of people the are budgeted for. Gotta love state bureaucrats

Nebraska "Firearm Purchase Permit", issued by local PD or Sheriff department may be used to purchase any firearm. Historic info, when these permit forms were first sent to various LEO departments, they were titled as "handgun purchase permit". New forms sent out at a later date. Good for 3 years.

Nebraska issued concealed carry permit may also be used as the NICS check in this state for a firearm purchase.


Dealer may choose to accept either or run a NICS check.

Colorado does too, state system, get approval in less than an hour...And social security number is optional..I was at the LGS and guy got a delay, pretty common name but no SSN...so...I just put it in..
 
Keep track of how often you get delayed, especially if you buy lots of firearms. If it happens once in a while, I would say it isn't a big deal. If it starts happening on every transaction, that would be more worth looking into. One thing you can do is file a VAF or Voluntary Appeal File. You can read up more about it.

I don't think you understand the information on the map.;)
For Nebraska dealers, if the buyer/transferee does not have a state issued handgun purchase permit (or firearm purchase permit) the dealer calls the FBI for the NICS check on long guns.
And that's exactly what the map legend says.

If NB has changed state law and requires a permit to purchase a rifle or shotgun.....then cite it.

Bottom of page 7: "10. Purchase certificates also can be used to buy long guns, but are not required. Under Nebraska’s split system, gun dealers can initiate a NICS check for long gun sales at the point of sale."

Again, the FBI info is correct. If the buyer/transferee does not possess a Nebraska purchase certificate or a Nebraska Concealed Carry Permit, that dealer calls FBI NICS for long gun checks........just like the NICS map says.
 
What I have always found strange throughout firearms purchasing history is an established cooling off period, a waiting period, a delay. a denial, etc - I would guess like most on this form, I would not go to the trouble of purchasing a new firearm to commit a crime, I would just use one of many that I already own - why go to the trouble - crazy, counterintuitive stuff?????

I've found out first hand why they have the waiting/"cooling off" period, and it works to great effect. Except I was too dumb to utilize it. Found something I didn't want or need, but man it was so cheap I couldn't NOT buy it. If I woulda cooled off, I could have possibly talked myself out of buying. But I didn't.

“Combating white nationalist violence starts with a president who is willing to call out racism and put the tools of the federal government to work in tracking the scourge of extremist violence,” he states in the proposal.

His plan proposes increasing investments that will enable law enforcement to identify and prosecute white nationalist extremists and creating international alliances that will strengthen counterterrorism efforts at home.

Inslee also proposed limiting the “ease-of-access” to firearms by creating a national assault weapons ban that will apply to firearms like the AR-15 semi-automatic rifle, which was used in the Dayton shooting.

Citing the rise in hate crimes under the Trump administration, he proposed making a misdemeanor hate crime one of the list of federal prohibiting factors that would prevent a person from purchasing or owning a firearm.

The proposal suggests prosecuting those who attempt to buy a gun while ineligible, banning “ghost guns” that are untraceable, implementing “red flag” laws, and improving the Bureau of Alcohol, Tobacco, Firearms & Explosives systems so that they can conduct thorough inspections.

The VAF is no guarantee that you won't get delayed. It definitely helps though. I had to file for a VAF due to having my ID stolen. I have been denied once even having my UPIN and have gotten delayed a few time. The longest delay I had was 24 hours. That was when they had just started the computer 4473. It took 24 hours for a real person to review my background check.
