Form 1 SBR questions

Wanting to make an SBR. AR15 7.62x39 with a 10.5" barrel.

Ive read through the form1 sticky and some others. Im not good with legalese...

Can I register my current DPMS lower as the SBR? Then can i continue to use rifle length uppers as well as the SBR upper? I think ive read that you can. I am familiar with the TC contender pistol/rifle/ and switching back laws. Seems similar.

I downloaded the form from the ATF website and skimmed over it. If i were to build this off of a new lower, and cant build until the stamp arrives, how am i supposed to know the serial number? Or am i supposed to have the receiver in hand first? Seems like a sort of gray area to me.

Yes

You have to have the receiver first and use the serial number of the receiver you intend to SBR.

The CLEO needs a copy of all forms listed as CLEO copy, minus the photo and finger prints.

And finger prints, where do i get that done at, the police station? And does it have to be in your home town, county, or state capital? I work in the state capital city, but live a county north in a tiny town without a police force. Do i just go to the sheriffs office in the county seat?

You can get the fingerprint cards done by anyone setup to do them.

On the "reason I want to craft this firearm" question, is there a particular reasoning I should put for ease of acceptance? Or is collection/target shooting acceptable? My gramps lived in MO where he had to fill out forms for pistols with a similar question and those were his types of answers. I assume self defense isnt the best answer?

I have only purchased maybe four firearms personally, through cabelas and the like, so these forms arent second nature yet. Most of mine are inherited. My next acquisition (or build) will hopefully be a suppressor so this will be basically the same process, correct?

If you live in a rural area send the forms to your local county sheriff.
FYI you will have to list the name and address of the sheriff on the form sent to BATFE

To answer the question" Specify Why You Intend To Make Firearm" (question 4 (i))
I always answer,
"All Lawful Purposes"
and have never had a problem.

CLEO is usually the County Sheriff unless you are in an incorporated municipality.

Typically, for fingerprints you get them where the CHP does that, but they have to be on the FBI form (IIRC). This is like to vary State by State. In Texas, I can go to the DPS license office for fingerprints.
 
Take your existing g dpms ar15. Fill out the paperwork using the dpms serial number. Keep using the ar15. Once approved you can put any length barrel on it at any time. Cleo is typically the sheriff. My local sheriff office fingerprinted me for free. I brought my own cards the atf sent me. https://www.atf.gov/distribution-center-order-form you want fd-258le. They are free. You might as well order 6 as 2. That way if one messes up that's okay. And you have a couple for the next time you need one. Like for your form one can you know you need.

And yes, the suppressor process is basically the same. The suppressor is a little more complicated because you have to create a name and caliber and sometimes that can be a little tricky putting it into the website. I wound up having to call the ATF halfway through my Form 1 paperwork for help. It was very easy to do with the agent on the phone. They were nice.
 
You have to have the item 1st because you must know the serial number.

You can have anyone take the fingerprints, you can even take them yourself. What’s most important is that you use the correct card. You can order them from the ATF website for free and that guarantees you’ll have the right ones.

I’ve always stated “for all lawful uses” as my reason, except I think I put “backpacking” when I SBRd my 10/22.

When I filed for my latest silencer I sent my LEO copy to the state attorney general. I think that’s what Silencer Shop does with all of their Form 4 transfers. The attorney general is the chief law-enforcement officer for the state. Nothing I found in 41F indicates it has to be a local CLEO. I never received any sort of communication back from the attorney generals office after I sent the form, so apparently it didn’t raise any red flags with them. ATF also approved the application with the AG listed as the CLEO so apparently it’s OK with them.
 
On mine it the lower wasnt on the "list" of previously converted lowers. Im using the angstadt arms UDP9. I submitted my efile on Oct5 and its currently still in the review stage. Guess it moves into the pending category once then send me the cover letter so I can send in my fingerprint cards.

If your lower isnt on the list you might experience a longer delay.

Is there an approved list we can view?

New one is a KE Arms billet model. I have no knowledge of the company but the website says 2013 on it.

Im sure a DPMS like my other lower, will have been SBR'd already.
 
You will see the list once you enter the manufacturer info, everything that manufacturer has been previously converted. If your model isnt on the list then you wait

or you call the atf and they'll add it while you're on the phone. At least, they did that for my form 1 cans that needed model name and caliber.

Ive talked to las vagas and Massachusetts and both agents said be patient, it was under review. No help for me. Glad your can went better

Pro tip........call the ATF NFA Branch, not a local office.
Some ATF dude in Vegas or Mass has zippity do da to do with eForms.
 
The agent in Vegas returned my call within 24hrs. He told me to call 304 616 4500. I thought it was in Mass but actually its W.virginia. The agent there was very polite, asked for my name and serial #. She said it has to be reviewed and be patient. Guess im waiting
