I really don't know anything about Gun parts. I'd think lowers would come with serial numbers?

"The suit names Blackhawk Manufacturing Group, GS Performance and MDX Corp., three companies that are not based in San Francisco but are responsible for producing a large share of the firearms found in the city and elsewhere in the state, Boudin said."

"The lawsuit, filed jointly with the Giffords Law Center to Prevent Gun Violence and law firm Keker, Van Nest & Peters, alleges that the companies violated state laws that require them to apply for serial numbers and that they misled consumers into believing the weapons were legal. It seeks a court order that would bar the companies from shipping their products in California and also seeks monetary penalties."

Either a piece of metal is a gun or it is not. The ATF has ruled that incompletely-machined AR lower receivers are not guns. This local lawsuit seeks to override the federal determination. The chance of doing this is low. Sounds like grandstanding.

Now, whether the ATF revisits its determination, is another issue entirely.
 
I have 80% lowers and a 0% lower (solid block of aluminum shaped like a lower). I also have aluminum shavings that could be melted and forged into a receiver. It’s a matter of where do you draw the line between firearm and non-firearm. Is bauxite ore a firearm??
The ATF has already established where the line is. I think the chances of this lawsuit changing the definition is slim.
California’s law requiring a serial number applies to the entity converting the 80% to an 81%+. NOT the manufacturer. Using their logic, why not sue Alcoa?

CA, and some other states, has more strict laws than the ATF.

Los Angeles recently sued P80 along with 2 LA Deputies that were shot. DC did last year as well.


However, 80% are not illegal in CA. Completing with out a serial number is.

You have to apply for a s/n before completion and meet minimum specs to stay legal. I think some companies will even engrave the s/n before shipping if one is proactive enough.

In short, they're not just "virtue signalling" (see we're on the side of law and order - their definition of course...). They're also forcing small companies to defend themselves in court while the public side -is being financed by taxpayers... they're also adding one more thing to the anti-gunners arsenal of dirty tricks - and it they have even the slightest success in the process - others will follow... There just aren't any penalties for what amounts to malicious prosecution that I'm aware of. Even knowing they're going to lose - they get enough "wins" in the process..

Wish it weren't so...

This is exactly it. Over the decades they have learned that changing laws in legislators is incredibly difficult, and challenging laws in the courts doesn't guarantee the results they want and the Supreme Court is arguably more friendly than it was in years past. So they go after civil suits to bleed manufactures dry in legal fees and gain public awareness.
 
curious if FOPA doesn't protect them because they're not manufacturing "firearms". you wouldn't need a type 2 FFL to manufacture chunks of aluminum. and anyone could sue you
 
The major manufacturers solved their issues by moving to Constitutionally friendly states. I find it interesting these makers decided to stay and brave the highly restrictive environment.

As for the guns being 50% of the murder weapons recovered I call BS. It's a Fake News media hit piece.An FOIA request of a list of firearms held as evidence statewide would be both revealing.

This may all change in a few weeks depending on who wins the recall.
 
The end game is to dis arm the population for control and they will not stop the constant attack until there are no more citizens with firearms.Very sad times we live in.I think as a country we have more important things to worry about than this, but what do i know!
 
I escaped in 2000. I do miss salt water fishing sometimes, I get over it:):). Very sad what has happened in California. I had great time growing up there in the 60's and 70's, fishing, doves,quail,chuckar and duck hunting.
Rock fish, Lingcod, Cabazion, Dungeons crabs, Salmon, …. heck Jack Smelt.

This is my 4th move to CA.
1st ‘83-‘88
2nd ‘89-‘’05
3rd ‘10-‘13
4th ‘18-‘22
All for work / jobs. The last time was so my wife could be nearer her grandson and to add to retirement that I was already invested in from the 2nd move here.

Over these years I have seen CA go from moronic to imbecilic to idiotic (using historical IQ terms)

Even if you could replace the state government elected officials with all Pro Constitutional / Pro 2A candidates it would take years to correct the damage in all aspects of life and law here.

I could go on for hours about this state on just their gun laws, but I will not. I don’t need the blood pressure enhancement and neither does anyone here.

I would recommend that anyone reading this that lives in states where Californians are migrating utilize any form of communication they see fit to let these folks know that you don’t want your area to become like where those people left.

As a lifelong Conservative I have often felt like I was and am living in enemy territory at times.
My “rights” are not the “approved rights” here. If only gun ownership could be construed as a sexual orientation…:rofl:

Could you, for non US readers, explain whats "80% lower"? Kinda dont understand. Over here is trigger group serialized part, if its fix part of lower, its restricted all, if its trigger group serialized and removable part, lower isnt restricted - thats same principe in US?
American have been making their own guns since 1776. It’s a right given by God and the Constitution. 80% means, 80% of the manufacturing is already done, (you) do the rest.

It's trickled down to the sub-state level too. For instance, this was just passed and put into the municipal code in my home city. Between that, the redundant safe storage law, and the recent praise for our city attorney's misuse of "red flag" laws from the state attorney general, local law is becoming the new battleground for all this stuff.

they do. These companies are selling pieces of aluminum that are neither lowers nor firearms.

anyone who disagrees is welcome to say where on the scale from 0-80% they decide it’s a firearm. Legislation is still at 100.0% as far as I know.
