I know some folks that was feuding with the neighbors. Best I know, the folks were shooting unsafely but legal. Cops were called. But nothing done. So after the cops left, the first guy gets his rifle out and according to the neighbors shot at him. Cops come back and nothing done. No bullet holes or dead horses or neighbors. Turns out later on, least what we can tell, they were firing blanks at the neighbors. Nothing was ever done.

That's the kind of people you're likely dealing with.

Keep the Sheriff involved. Sometimes it takes a while. They will screw up.

When the says "his dogs is at home", that means you have a predator. React accordingly.
 
Sadly, there are too many who foolishly think 1/2" plywood is all the "bullet stop" they need.

From those photos, they have, on their 3 acres other places that could be used as backstops.

Keep track of any expenses you incur for putting up materials--you have an option of going to the Justice of the Peace and making a Small Claims Court filing to recover your costs resulting from the neighbors' negligence. (Typically in the US, Small Claims can be up to $5000, and do not require a lawyer, and have a filing fee of $25 to $50.)
 
so talked to 3 deputies today, first ine in the morning went over to talk to neighbor but he wasnt home so he left. i proceeded to put up some more trespassing signs just in case. when i get home, i do live 15 min from that property i get a call from him screaming and yelling i need to take my electric fence down i put up to keep his dogs out, he says his 2 year old almost touched the fence. so he was standing tehre watching his kid touch the fence? he said if i dont come out and remove it he will do it for me. told him when we had fence build we had it moves 1 foot in from property line for cases liek this. kept yelling at me so i hung up. called the sherrif back told him what happened and i dont feel comfortable goinf out tehre myself. he said he woudl call him and call me back, never got a call back. get back out to horses do my lessons have about 6 little ones tehre and parents and he starts shooting again. call teh sherrif back and finally one come sout to look things over. take him and show him all the layout. he goes actually the backstop aka my pasture hill is actually a pretty good back stop. i was like *** its my property i dont want him to be using my hors epasture as a back stoip for his shooting then i aske dhim about how far away he has to be from livestock barn to shoot and he hoes there are no regualtions on .distance when discgarging gun in county. waiting to hear back from deupties? do i need to look for a lawyer/ i dont want that guy to poiosn my horses but i also dont eant him to shoot into my property

...including the hours you spend doing same, at a reasonable value such as your work hourly rate. If you can use the information or not is excluded if...you do not keep records. A wall calandar is cheap and will generically suffice.

I still cannot discern if this is a renter vs. owner, Actions certainly speaks of a renter (person with no real skin in the game).
Filing a suit for damages including disturbing the peace and various unsafe acts is always an option. I think any justice will answer ''where did that bullet go, when it exited the rear of the board? You know, towards the camera lens?'' ...only one way. Which is the only way it can be answered.

Hoping cooler heads prevail seems to be a failing approach with the human yelling & screaming about YOUR elect. fence. A visit from the sheriff rattles some folks, seems this human is a bit tougher skinned. In any event LEO visits goes on a sort of record and is generically called an involvement.

I again advocate for exterior cameras with rudimentary monitoring. God forbid something like post #24 happens, best to have a record if at all possible. The worst plan is one that does NOT plan for multiple contingencies, you have a trespass PLUS safety problem , which shows no sign of subsiding, and need to forever monitor all facets of it.

And it's just a good idea these days, there are lots of bad hombres out & about. The days of leaving the front door unlocked are over also.Fortunately today's elect. cams with immediate ringers to your personal phone are VERY inexpensive, and, VERY accurate even in low to no light.

An initial consultation with an attorney with a followup formal letter to all parties (renter and/or landlord) is appropriate at this time. Unfortunately, some people do not cease activity until designer bracelets come out (a.k.a. handcuffs) and/or ... ''we are getting into your wallet, NOW'' letters are not only sent, but acted upon.

Again, hoping cooler heads prevail, all calms down, dust settles etc. all you EVER see is raccoons in your cameras LoL and it ends up being a nice Thanksgiving season & beyond ! !

we have no law on where u can shoot, they only regulate hunting but not discharging firearms close to building livestock etc
 
your house and horse barn definitely constitute an occupied dwelling.
do you have a camper you can park by or on your hill?
Your county contains Kearney so 28-1212.04 should apply.

Any person who unlawfully and intentionally discharges a firearm at an inhabited dwelling house, occupied building, occupied motor vehicle, occupied aircraft, inhabited motor home as defined in section 71-4603, or inhabited camper unit as defined in section 60-1801 shall be guilty of a Class ID felony.

Discharge of firearm in certain cities and counties; prohibited acts; penalty.

In Texas “ Trespass by projectile“ is a crime. Unfortunately my neighbor was charged after he shot my truck on my property. He said he didn’t know what was beyond his target
I hope things work out for the best for you, but some people are just unreasonable. A lot of people are ‘moving to the country’ not because they value country living but because they are in constant conflict in more densely populated areas. They bring their belligerent personalities with them.
 
In the course of communicating with law enforcement, lawyers and the like , take great care to do so in a clear manner.

Upper case where appropriate , proper punctuation and spelling will help to make your case clear and processable.

His dog tried to attack a motorcycle, got ran over by the following motorcycle which caused a crash with very serious injury to the man and woman riding it. Neighbor was warned that he would be responsible for his dogs if something like this happened, too stupid to take that warning seriously , now he's headed to court and the woman in the motorcycle has permanent handicap from broken leg, pelvis, and shoulder.:fire::fire::fire:

Hopefully he has the insurance and/or assets to properly monetarily compensate them.
 
@Horselady, I know people who were born here whose English is far worse; you're good. Belated welcome to the United States - you are the kind of new citizen we REALLY like to have!
I am not a lawyer nor do I play one on TV, nor do I knw NE law, but with this opening hostilities, I might recommend carrying a sidearm with you on your property. The villain has already clearly communicated a complete disregard for human life and refuses to acknowledge his own responsibilities. As I tell my staff, when in any situation, document, document,. document - if you don't write it down, it never happened. Video is a HUGE plus.
As for the person in question, what was that thing that famous writer said so long ago about some people just have to pee on the electric fence themselves? Sounds like he is definitely in the "slow learner" category. Please keep yourself safe!
 
How can a permanent injury be "properly monetarily compensated"? For how much would you accept pain and some level of disability for the rest of your life?
There is, of course, no equitable monetary compensation for a permanent injury.

But if expensive lifetime care is needed, it should be the negligent party providing the necessary funds.
 
Aside from how far from buildings, noise, etc, what really cuts it for me is his lack of a backstop.

His bullets need to stop, in the earth, on his property, every time, all the time, no exceptions, and without question. I would start there with the sheriff.

Yep, his rounds cannot legally crossover his property line.

Assuming the neighbor is an irresponsible thoughtless jerk and won’t stop being one, it seems the OP can do one of 2 things, neither will be easy or cheap:

a). Best hope. Show law enforcement that the neighbor is acting unlawfully, including the statute(s) he is violating. If she can do that, she then must persuade LE to act, i.e. either issue citation or arrest the neighbor. (The statutes cited by atavar don’t seem to fit this case.)

If he isn’t breaking any laws, then

b). file a civil case. She will have to show a tort has been committed by him to her, and prove her damages. Should get to court this decade perhaps. He won’t have money to pay even if she wins. But maybe just filing the complaint will do it.

The frustrating fact is that jerks are a misery but often they aren’t breaking laws, and are free to continue being jerks.

First talk to a good, experienced, conscientious lawyer. The aren’t easy to find, and they’re busy.

Probably easier and cheaper to build him a nice range on his property.

Taking ‘action’ she dreams up on her own or gets off Internet forums, hoping to persuade him to stop, is unlikely to work and is dangerous. The unforeseen possible consequences are not worth the risk.

I would build a shed between your hill and his property. Then if he shoots, he’s destroying your property.
