DELAY on NICS Background Check for everyone at LGS this afternoon

I have been delayed once since the start of the plandemic and that was back in June or July 2020 when the NICS system was getting overloaded. The delay was about 1 to 1 1/2 hours long. One thing different with me is that I have a UPIN that I also must submit during the NICS check, without my UPIN it would be an instant denial.

I mention this only to show that there will/can be delays with NICS system when there are a lot of background checks being conducted at the same time. Maybe this is what is happening currently, they are getting overwhelmed. We all know that firearm sales tend to increase during elections.

LOL. Have to wait several hours because of a computer glitch? Boo hoo. Like Washington State, California is a PITA for rifles and handguns.....10 day wait (to the minute) after the paperwork and background check. Don't ask about background checks to buy ammunition.

I would not be surprised if this is a test to see how they can shadow ban the second amendment.

It should not matter if I've purchased 1000. The number is irrelevant. The fact that there were blanket denials across the board going on is what is the most troubling.
It's a technology world these days. Sometimes the magic works, sometimes it doesn't. I still don't think you or anyone else at your LGS when this happened needs to worry about your 2A rights. Sorry but your kind of worries are what conspiracy theories are made of.

The FBI NICS system is just another data base. And if you know anything about computers and/or data base programs, then you will know that more queries at one time will slow down the system.

With that said, I would still watch this carefully since we know how the current administration is. But for now I would not call it a conspiracy theory. If it were, we would see more problems right now. And we have had purchasers along with FFL holders state they aren't having any issues.

I have purchased over 100 firearms in my life time, and I have never NOT been delayed, so the OP only being delayed once in his life time and blowing a gasket over it has me ROFL... I'd love to trade places.

I am use to it and plan for it. I will usually stop by to do the paperwork while on break, and then stop by when I get off work to pickup. If I am off that day, I will get there around lunch time, fill out the paperwork, go eat lunch, run errands, catch a movie, etc, and then go back to pick up.

I have bought dozens of guns in the last ten years. Every single one of them resulted in a "delay" followed a couple of days later by a "proceed." Since there is nothing I can do about it, I've just gotten used to it.

This is textbook normalization of deviance.

It's important to remember several things here.
1. NICS was a computer program contracted for by the USG. In the 80s. We are incredibly lucky it does not use punchcards. (It may, in fact use COBOL, though).

2. All of the modern interface stuff was contracted out, again by USG, in the 90s, and laid on top of an 80s database product.

3. The current system relies on things being "average." Get a state that has a deadline for a major new gun law change. Or, maybe it's the Friday (payday) before a big holiday and people want things to shoot/hunt with over that holiday. Also, there's an expectation that phone line, and www lines are not having traffic issues. Weather this w/e has affects a couple of hub for both of those.

May not be nefarious, but just the same level of competence that runs the DMV.

It's textbook reality of the situation. NICS checks are the law of the land. Some people are delayed all the time, some are delayed sometimes, and others are never delayed.

No point in me whining, crying, and throwing a temper tandem over something that can not be changed. Delays are normal and nothing new. You just have to live with it.

Ran three FBI NICS checks between 5pm and 8pm tonight..........no delays, no denials and no conspiracy theories.
Do your checks go straight through to the FBI or through the state police first? I know in my state, the VA state police handle background checks.

During 2020 I had a few gun purchases that had the mandated 10-day wait turn into 20+ days. Add in the time for the auction to close, shipping, the extended wait, etc. it was over a month from my initial bid to bringing it home for these purchases.

Ya, its a pain. The State blamed it on hysteric gun buying and pandemic staffing shortfalls. But at least they went through, my guns came home and alls well that ends well.

Stay safe.

You are in Texas it seems you have been here for years so why no LTC (use to be CHL)? CC has only been law for a couple of years now. Just because you cannot carry at work is not a very good excuse not to have your LTC. Classes are inexpensive and so is the LTC. There are many more places you can legally carry with one not to mention bypassing the NICS check. Takes me as long as filling out the 4473 to get my firearm and always has since I got my LTC long ago...

I have had delays and wonder why. Here in Minnesota my permit is supposed to exempt me from the background check.
Of course this is a state that takes 6 months to deliver a drivers license. I have one friend whose license plates expired before he got his title.
Next door in North Dakota they hand you your drivers license before you get out the door.
It’s a red state blue state thing.

No police agencies involved in TX background checks.

California has had a waiting period on hand guns for quite some time now. The waiting period was two weeks when I was stationed there in 95-96. And I was almost denied the transfer by the county sheriff simply because Ft Irwin would not release any information to them other then to state that yes I was stationed there.

I am a victim of ID theft, my brother stole my ID and used my name as an alias. I used to get denied each and every time and then would have to file an appeal along with submitting finger prints. That all stopped once I applied for a VAF and was issued a UPIN.

I did get denied twice after getting my UPIN. The first time was shortly after receiving my UPIN and my dear brother got into trouble yet again. I had to appeal the denial and also have them update my VAF at the same time. The second time was shortly after local shops started using the online background check system. The system would automatically deny those even with a UPIN. That time the local shop got a call from NICS early the next business day saying that the transaction was a proceed after an actual human looked at things.

Now the online BG check goes through instantly for me, other than the one instance in 2020 which took about an hour.

I feel for those who have had their ID stolen by someone who is dodging a ticket or arrest. As you certainly know first hand, the hassles the victims have in these cases is a years-long headache for sure!

I recall an identical twin sister who had that happen to her. They were so close the only way to really ID them was by fingerprints. So, after the good one was arrested for her sisters warrant a couple of times , and later released later when the prints returned to ID her, she got a tattoo on her arm that easily set her apart and stopped the misidentification issues in the field.

The 10-day wait is a pain that really is not much more than another flaming hoop for prospective gun owners to jump through to make gun buying a burden. Every time there is a riot (or “mostly peaceful protests” in todays media doublespeak) numbers of people are shocked to learn that they are then forced to take a test to pass a gun safety lesson, then are denied their purchases for ten days. Heck, if you haven’t bought a gun in Ca before, to legally buy ammo for the first time costs them $19 bucks and a 10-15 day wait. If you are denied, the denial is mailed to the person making the purchase. (Another delay!)

It is ALL about finding ways to deny 2A rights, with the hope people will get so frustrated they quit buying guns altogether.

Stay safe.

Cannot be changed? Now that is textbook defeatism. The goal should be to have the entire system dissembled and done away with, something that could be done by congress or by a convention of states. Any time we start accepting an infringement on our rights as something that "cannot be changed" then something has gone seriously wrong.

Defeatist vs Realist

In short, a defeatist expects defeat and doesn't need to analyse. A realist expects the normal actions of reality, and therefore must analyse reality in order to come to a conclusion, which may be for defeat or victory or something entirely different.

That sounds good and all, but I deal with reality. The reality is most Americans including many gun owners support background checks. I have seen countless debates on online forums were gun owners only sold to gun shops, put firearms on consignment, or did face to face sales via transfers at gun shops even in states where private transactions are legal because they want background checks and a paper trail.

I can virtue signal and say things that sound good, but the reality is there's not enough votes in Congress. Even if Republicans win the majority (which they have several times in the past), the likelihood that they will undo NICS checks is highly unlikely, and that's an understatement. The current SCOTUS is also not likely to deem it unconstitutional.

I don't like it and I will support efforts to repeal it, but I live in the here and now real world. Right now, it's the law of the land that's not going to go away where in the near future no matter how much I opine about it, so I have to deal with it and make the best of it. I am accepting a reality that I do not like.
