Braced Pistol stamp Watch Thread

You may be correct, that was my interpretation of the instructions.
I didn't "build" my AR pistol, I purchased it in that configuration, maybe that makes a difference....??

Well unfortunately logic can't be used to figure out the ATF as they go out of their way to be illogical hah

you are correct Bwalker logic and atf don't go hand in hand. And I did consider that as well as to adding a photo . But I kept reading block 1c
" Tax Exempt. Firearm is not subject to the making
tax pursuant to Title 26 U.S.C. §§ 7801, 7805. To confirm
the application qualifies for tax-free registration, ATF
may require additional supporting documentation,
such as photographs of the firearm to be registered."

It will be down to the examiner on these issues such as the issues of photos, hopefully I will draw Kim Roland or Beth Palmer again both of those ladies processed my earlier tax stamps rather quickly in the past on suppressors every one of the them took 18 months for a simple form 4. (that sounds snide but honestly that was in the middle of the great suppressor rush/buy that they handled approx 1 million applications during that period) Not bad for a bunch of Contractors (at that time the staff was I believe was 15ish people handling all the applications for every NFA weapon Gov't and private) working for ATF working at the FBI terminals in Martinsburg WV.

I' m thinking My forms submitted (6th Feb) will be handled around 18th to 28th of March that allows a 40 to 50 window. Actually I'm just a happy camper for a approval prior to May 31st.
But I did note that Illinoisbert's son approval came in at 33days during the advertised 30 day window.
now to log in and check on my status again to make sure it's still submitted/processing

I probably would have too, if I went tax exempt route. Still can't believe I got one back in 10 days
 
Unless the approval form is listed as "in accordance with rule 2021R-08F".
If rule 2021R-08F is ruled unconstitutional then the approved form could also be unconstitutional.
You do not get a stamp as no tax is paid. You simply get an approved form and if there are restrictions on the approval that could void the form.

The lack of a tax is from the authority of "the Secretary", not the rule. The NFA gives "the Secretary" latitude in determining what NFA transfers or makings require a tax payment.

LOL I was going to state the Same exact Fact you mentioned to SC45-70's comment just didn't. Anyway I just logged in 10 min ago looks Like 1 of my two are undergoing processing now appears the 5.56mm will be process sooner than my 9mm. Even though the 9mm was entered first. now to keep a eye out to see if the examiner will ask for a photo??? keep fingers crossed folks for me as it is hard to type while my fingers are crossed.
 
It may have been stated here, but you will NOT get a tax stamp. You get a signed letter of approval.
 
A guy did a YouTube video on this process. He was tracking the process and he got his approval and there is NO stamp. He showed the signed approval letter from ATF. It was a legit video. My local class 3 gun shop where I did my applications thought we would get a stamp. I will square him away today.

False alarm it was just a burp on the screen which caused me to think that a examiner had taken possession of the file within e-file system ... :( back to waiting

Not my first time for NFA items, but is first time for e-forms, coupled with I don't like to be in or perceived to be in any violation / infraction. (the burr under my saddle is the verbiage of a blanket SBR of any pistol with a brace that they have used).

NO !!! I don't expect my door to be busted in with a FBI HRT team with a ATF or two agents stacked outside while a team of US Marshals poised to drag me away in irons after shooting my dog. Or my application to be used as a sole source for charges, that already has been decided on with a Supreme Court ruling in 1968. Ruled unconstitutional in the favor of Hayes.

Finally broke down, called NFA Branch today. I went out of my way to be nice with the Lady I spoke to, stated I know that really she couldn't tell me anything but submitted/processing.

She brought up the shift of estimated processing time of 30 to 40 days I mentioned I was aware of the change, it's a guide they attempt to meet. Also that I knew my application would be up soon, my concern was if everything was as it needed to be for the examiner to adjudicate disposition in a efficient manner. She went out of her way to validate that the digital documents/ fingerprints was in a usable status. No glaring issues with the forms. Then I mentioned that I know they are swamped as well as short staffed. Also that my last understanding was they was authorized 16 examiners from years ago. She alluded that that number was increased (20ish) prior to e-forms coming back online for the second time, but because of the hiring process they simply have not seen any real increase in help. We never discussed how many examiners the branch had but rather if at full staffing level. I expressed my remorse for them as a department, and understanding that the hiring process is so slow and difficult within any US Federal Government position given security clearances, background checks etc. I further stated they are pretty much in a pickle with the release of the pistol brace rule and a mass influx of application. Then she mentioned the latest IRS hiring and I replied in a joking manner yeah too bad ya'll shifted from the Treasury department years ago, ya could have swiped some of the new hires to help. She giggled and agreed with me, really seemed to put her in a good mood. And then we discussed the e-forms system itself very briefly on the end user visibility and abilities. I thanked her for her time and efforts. Which honestly the call was very much quicker that it took for me to type this out

No I don't sit logged into eforms checking because of reducing the bandwidth, I don't want the system to bog down, LOL that being said I use and abuse my e-mail checking to see if they need something from me to process . I'll usually check e-forms after their normal hours to see if approved or a message was sent in the event that the e-mail gods decided to work against me.

Typing this seems to help with my anticipation.

While I don't have much if any faith with the ATF in certain aspects, I do have extreme faith in the folks working there (NFA Branch) to do their jobs, be fair, and be professional while processing a application within a timely fashion. In the end of all this if I get approved or whatever the status within a 9 month window it will be the fastest I've ever received a form back from them. These long wait times we experience is always the fact that they are understaffed not because they chose to be, simply because of the hiring process. If it is modified it would actually be to our detriment having unqualified folks handling tax documents is not a good thing. Before somebody pipes in well no tax was collected these application is still a tax document and will always be.

Thanks to everyone for allowing me to post this as a therapeutic.
As I know that really a NICS background check only takes 5 min or less when it's not crashing or down for maintenance which also adds to the anticipation. The other great side I see is that with e-foms is that the system isn't bogged down by the examiners having to enter data into the NFRTR which speeds up their processing.

Hopefully some or all will see the humor I've attempted even if poorly delivered while sharing some of my discovery of the issues from the other side of the application process.
Like I have seen Dogtown Tom (the Fine Texan that he is, based on what I have seen from his post I have respect for him thus far) has stated the NFA branch folks aren't the enemy, they are human. We as a group need to remember that when checking on our individual status.

I have the tracking reciept with person's name who signed for them but other than that, no other confirmation. Since I work for a US Govt agency, I am well aware of the implications of "we never recieced your cards" and the uselessness of trying to prove they signed for them. The other is I also have a paper form 4 my dealer sent in for a supressor. I would like to see this listed in my e-forms account. More like I wish I had an ATF account that showed all my applications and the status.

When they make the decision, you will get email. No need to go to the website.

All the times I have called the NFA #, they have told me the date the form was submitted, and the date they received the fingerprint documents.

The answer I recieved was that there are A LOT of various forms submitted, and there are FEW worker bees to handle the load. I think they are concentrating on the approval/denial process first.
 
Submitted my forms yesterday using Silencer Shops tax exempt eForm service. SS advertises a 99.6% success rate...and they already have my picture and prints from my suppressor purchase. It was a steep price, but I don't have to worry about finding a place to scan my prints, take another photo and the possibility of goofing up a form. It's a piece of mind purchase for me. I did submit pictures of just the engravings (they highly recommend pictures). I know there will be a few extra days until SS can get my forms ready for signature. I'll check back in later to start the clock.

Steep price? Aren't they asking $50? Since I already have prints and picture on file with them awaiting a suppressor, that seems like a deal for not having to go through the hassle of having to obtain prints.

I am still on the fence as to whether or not I am going to SBR my braced pistols or remove the braces.

Yep, $50 per form. It does save the hassle of prints and picture. But factoring in the savings of prints and a picture, it still cost me about $100. Steep, but money well spent.

Ask me if it’s well spent if the rule is overturned and we are told to put the braces back on.

I thought about holding out until the last minute to see if the courts would order an injunction. But seeing how bump stocks took 4 years…and I was going to SBR at least one of my pistols, better safe than sorry.

My two have been setting out there in draft form since the inception. I decided to join you in this quest, and just uploaded my photos, spent the $100, and submitted the two of mine. Since SS is donating 10% of this to gun rights groups, I won't worry about the other $90 if everything goes kaput later.
