Marlin 60 and the upcoming AWB?

I just read a provision in Feinstein's new AWB that would ban the sale, manufacture, importation and transfer of:

"Semiautomatic rifles and handguns with a fixed magazine that can except more than 10 rounds;"

If I'm reading that correctly my Marlin 60 with it's 14 round fixed tube magazine would be an NFA Class III firearm. Seriously?!

God, I really hope the good Senator's AWB bill fails. :cuss:

"Upcoming"? It's not "upcoming"... it's being proposed, but it's not gonna happen.

The Marlin 60 is a perfect example of why the bill stands the biggest chance of defeat in committee. IMO, as a few have discussed, if the bill really only targeted ak and ar type firearms, it probably would have passed. They went for broke, and it's not going to settle well when everyone's 10/22 is targeted.

If it happens as an overlay to California's type of ban - I wouldn't count on the above given the effect of the Cal AWB on the Henry holding more than 10 in the tube.

Magazine: An ammunition storage and feeding device within or attached to a repeating firearm.

Fixed: Neither removable nor detachable without tools.

It already is in New Jersey - the original Marlin Model 60 had a 17 round fixed tube magazine. A court challenge went all the way up to the NJ Supreme Court and it was found to fall under the NJ AWB, so all older Model 60's are banned.

"When dealing with guns, the citizen acts at his own peril," wrote the NJ Supreme Court when it upheld the conviction of the owner of a Marlin Model 60 .22 rifle as an assault firearm (State v. Pelleteri 1996).

The early Marlin 60s..

had 17 shot tube mags. Some of the early tube mag rifles will shoot 22 short so you can cram 20 or so rounds in them. How long does it take to empty a tube mag 22 rifle? Not long and no recoil to condend with....chris3

I also have two ARs and three pistols with mags that hold more than 10 rounds. I was going through my collection and was curious about my M60 after reading what I saw. I have 20+ mags for those ARs and pistols so I do have a lot to lose. Your sarcasm really is not warranted.

There are provisions in Fienstein's bill for 22 rifles with a tubular magazine. Well, it's not a bill just yet. It is the ramblings of a paranoid lunatic who managed to get a carry permit despite her illness.

Of course she'd go that way as her CalAWB exempts rimfire tube feeds as well. This is part of their "See, we're being reasonable..." tactic.

California's AWB requires ARs to have a fixed magazine but it's a stupid requirement since the "tool" used to detach the magazine (bullet button) is as simple as the tip of a .223 cartridge or a pen.
