Concealed Firearm Permit vs. Brady Background Check in Nevada

I live in Las Vegas Neveda, and recently a friend of mine was looking to buy a gun for his Christmas gift. I saw him this last Saturday and asked if he got one. He said he did, but then he told me something I didn't expect to hear. He told me he had to pay for a Brady Background Check (BBC). I asked him if he had his Concealed Firearm Permit (CFP), and he told me he did. From my understanding, at the beginning of the year, the laws were changed to make it so you didn't have to go thru a BBC if you had your CFP. He told me he showed them all his paperwork (blue cards etc.) and he still has to pay and, wait a week to actually get his gun. This is contrary to what I have been told is the existing law. Any one out there who is versed enough on Nevada laws to weigh in on this?
 
It's only good for background check provided permit was issued after 7/1/2012.

Turns out that the Sheriff's and Police Officers Assn decided not to correct the background check date to make it effective for all. Its all about revenue.

To make matters worse, you cannot early renew. So if you received your permit days before 7/1/2012, you get to wait 5 years and pay the background check EVERY purchase :cuss:
 
I have never lived in NV. But I've never, ever paid for a background check anywhere I've lived.
 
It's been quite the debacle. In the distant past up to a couple years ago, no background check if you had a valid CCW.

Well the ATF said the sheriffs depts (rumored to be Clark County) were not doing annual background checks (using the dollars of which you paid when applying for permit) and gave the S/Os 6 months to correct. Well of course that didn't happen. So ATF revoked the waiver for CCW permittees.

Time goes by (about 2 years) and and finally some action between ATF and S/Os.

A deal was brokered between ATF and S/O and all should have been fine. The story goes, there was a administrative error wherein the effective date on the document for waiving the background had the date the document was prepared entered as the effective date. One would expect that no date should be a factor, thereby covering all permittees. Whether this was by design or error remains a mystery an most likely will never be know.

So a few months later, the Police Officers and Sheriffs Assn meet and decide that the date will remain in effect. At this point there was on contention with ATF.

At first, after the date debacle, early renewals were possible, but due to the huge volume of early renewals, the S/Os abolished the early renewal option.

So those permettees issued CCWs before 7/1/2012 get to pay $25 every gun purchase for up to the next 5 years depending when the permit was issued. Those on or after 7/1/2012 get a free ride for the background check.

So there you have it... :banghead:
 
Remember, having a Concealed Carry Permit won't mean you can skip the NICS check every time. It allows the dealer to substitute the call for a CC permit, if they want to. Several gun dealers in Oklahoma (who I take handguns to, for transfers) ONLY call the NICS and do not accept CC permits.

One customer bought a handgun from us and I transfered to a nearby Oklahoma pawn shop was upset about this after he was delayed and demanded his money back. We gave him a refund, but will not ever transfer another handgun for him.
 
We have the same CCW substitution here in WV. It's relatively new, and I haven't bought a firearm since it took effect, so I don't know if my LGS routinely accepts the CCW or not. I'm pretty sure the SO doesn't do annual background checks.
 
Still a check here in FL, costs $5. Your CCW allows you to not have to wait for a handgun, however. Otherwise, they have that "3 day cooling off" period
 
In NYS you have to pay for your background check and fingerprint cards. Sets you back around $100 for a pistol owner permit.
 
According to todays Farmington Daily Times, Colorado now has a 11 day backlog for NICS check, and i thought that after three days with no negative reply the store could go ahead and make the transfer. Seems that I was misinformed or Co is breaking federal rule.
 
I have never waited for a rifle, shotgun or handgun in NV. Is this waiting period a Las Vegas/Clark County requirement? My purchases have been in Douglas County and I'm good to go as soon as the NICS clears (and yes I have to pay for that).

Last night I was told CO is up to 14 days now. We don't use NICS, we use CBI (CO bureau of Investigation)

This is not true in Nevada. The NICS check can be skipped every time with a valid CCW based on the date criteria I wrote of above. Granted the FFL can refuse to honor the CCW, but the buyer can and will refuse to shop from the FFL.

In 10 years I have never had a FFL (back when my NV CCW would waive the background check) do a NICS check.

Because, if the FFL would have insisted on doing that they would have lost a sale and word of such actions spread which would definitely be bad for business.
