Reduction of ammunition magazine capacity. The new law enacts reductions in the maximum capacity of gun magazines. We believe based on our years of law enforcement experience that this will not reduce gun violence. The new law will unfairly limit the ability of law‐abiding citizens to purchase firearms in New York. It bears repeating that it is our belief that the reduction of magazine capacity will not make New Yorkers or our communities safer.

Method of bill passage. It is the view of the Sheriffs’ Association that anytime government decides it is necessary or desirable to test the boundaries of a constitutional right that it should only be done with caution and with great respect for those constitutional boundaries. Further, it should only be done if the benefit to be gained is so great and certain that it far outweighs the damage done by the constriction of individual liberty. While many of the provisions of the new law have surface appeal, it is far from certain that all, or even many, of them will have any significant effect in reducing gun violence, which is the presumed goal of all of us. Unfortunately the process used in adoption of this act did not permit the mature development of the arguments on either side of the debate, and thus many of the stakeholders in this important issue are left feeling ignored by their government. Even those thrilled with the passage of this legislation should be concerned about the process used to secure its passage, for the next time they may find themselves the victim of that same process. Fortunately, the Governor has shown himself open to working with interested parties to address some of the problems that arose due to the hasty enactment of this law. We will work with the Governor and the Legislature on these issues.

Sheriffs understand their Constitutional obligations and the concerns of constituents Sheriffs and other law enforcement officers are not called upon by this new legislation to go door‐to‐door to confiscate any weapons newly classified as assault weapons, and will not do so. :eek::evil:

Sheriffs represent all the people, and we take an oath to uphold the Constitution of the United States and the Constitution of the State of New York. Sheriffs will continue to enforce all laws of the state and will protect the rights of all citizens, including those rights guaranteed by the Constitution of the United States and the Constitution of the State of New York.
 
Same thing here in Utah!

The Sheriff's assoc wrote a letter to the Governor saying they would not enforce any law they deemed unconstitutional All except Salt Lake Co.

Thats where all the commie libs live!

Sheriffs overrule Prez?

Read on this or another forum that, constitutionally, County Sheriffs have
"more rule" for lack of a better term , than POTUS or the governor of their state.
Can someone definitively confirm or deny this?
And,if it's true, how could we take advantage?
 
Does anyone know what they were allowed to carry before this last law was passed. Were they (police) restrickted to 10 rounds??
 
Lets see, first it was extra large sodas banned, next was formula banned from maternity wards in hospitals, now the guns and mags issue, what will be next? Believe me there will be more, it won't stop until everyone stands up and says enough!
 
Yeah I will say enough is enough by never travelling to that communist country they call new york.

How can we set up a legal fund to defend those in New York that are not going to comply with this law? We can and should, so if anyone has contact in the NRA / GOA / SAF, start needling them and let's see.

If people see that we will not tolerate this and see protests from Sheriff's, Chief's of Police, citizens and line officers AND, most importantly, financial / legal support from gun owners all over the country, then perhaps they will get the idea and pass some laws that target the actual problem.

Okay, so they are stating that the legislation doesn't mandate confiscation, therefore they will not conduct confiscations? Did someone somewhere suggest that LE would execute a mandate that didn't exist? I haven't been following the NYS goings on since the law was forced through that night, so I obviously didn't see/hear/read where this was suggested.

Okay, so they are stating that... crap rolls down hill; IOW... whatever the legislature spits out, they will beset upon the populace... right?

I'm trying to see the greater victory here. It's cool and all that these sheriffs banded together to "confront" the state, but did they say something here that would fall under the phrase 'push back' or the term 'resistance'? It looks more like a finger-wagging for the haste that was witnessed in the passage of this law, as opposed to drawing a line in the sand with the state on one side and the sheriffs and people on the other.

Before the bill was rushed through and signed into law, Cuomo is on record as saying, "Confiscation could be an option." His agenda is clear, even if that provision did not make it into law.
 
Cuomo wants to get local LE out of the picture as much as possible and put the State Police in charge of this. They are his private army. I know some troopers who are decent people, but by-and-large they don't question authority and they follow their orders to a T.

Cuomo has adding funding to the State Police budget just for this purpose. I think what the sheriffs are saying is that a lot of crap is going to fall on their heads anyway with this whole mess, and they're not going to get any financial support for dealing with it. Also, they're going to bear the brunt of dissatisfaction in the local communities about the new laws. Already they're getting bombarded with calls about what is legal and what isn't, and there are going to be routine enforcement issues that the State Police won't want to be bothered with.
