Holder Threatens Kansas Over New Gun Laws

I have to say that I really liked what the Kansas Secretary of State had to say about this matter and he is flat on correct. Other states' attorneys general need to do this to Holder and Obama as a reminder of the limitations of the federal government and the fact that the states had sovereign rights the feds cannot ignore.

God bless Kansas for their intestinal fortitude with this.
 
Kris Kobach seems to be pretty savvy about constitutional law. Holder migh be at the butt end of a precedent that will benefit all of us.
 
I very much like and agree with the responses from the Kansas Governor and Sec'y of State.

But I'll have a lot more respect for them when they actually arrest a federal officer.
 
Thanks Missleman for posting the links to the reply letters! I haven't read them until just now. The Jayhawkers seem to be convicted on this cause. I wish them the best of luck.
 
The federal government has yet to realize the problems they will have with ANY enforcement without the support of local and state authorities. I hope Kansas shoves that reality down their throats. The feds simply do not have the resources to enforce their will on the people by themselves, and New York or California cannot enforce THEIR misguided idealism on Kansas.

Until then it's all role playing. It's fun... really. I applaud it. Now the question is who's gonna start making AR lowers in Kansas for local sale and is willing to be arrested for his trouble? Taking 100 80% lowers, marking them "Made in Kansas", completing them on a CNC mill, and then retailing them without a license ought to be an easy way to stir the pot. Any takers? Who's brave enough to put skin in the game? Anyone? :rolleyes:

AND then there's Colorado that is trying to take the authority away from the Sheriff's and give it to the state police after the sheriff's came out against the new gun control laws.
 
You guys are missing an important point. The Governor and AG of Kansas are setting the stage for citizens of Kansas to make their own machine guns, and indicating that they will be exempt from the 1934/38 and 1968 gun control acts. I think this challenge alludes tha the federal government's laws for regulating machineguns and other restricted weapons are based on an incorrect interpretation of the interstate commerce powers. Kansas is challenging that those laws are invalid as long as the guns are made in, and stay in, Kansas. Thus the reference to INTRASTATE use and possession. I think these state challenges were started a short time ago in Montana. Law experts feel that states can exercise their sovereignty and state powers and win on this challenge, as it appears the federal government has gone too far in interpreting their regulatory powers over INTRASTATE commerce, and thus the regulations of weapons made and kept IN respective states would also be invalidated.

I'm sorry to say that a similar version of the Kansas law was put forth here in Montana and it didn't get signed into law. I had higher hopes for this state at this time.

Now I have about 3.5 years to try to get the sitting governer held to one term.

There's a similar bill in Alabama too, I don't think that it makes it a felony for the feds to enforce the law, but it does say that federal gun laws violate the 2nd amendment and they will be null and void in Alabama.
 
If KS pulls this off then I can see TX and OK right behind them. Not to mention AZ and probably a few of the southern states.
 
Let's have a little talk about the interstate commerce clause, the 2nd amendment, and the 10th amendment. :)

It depicts John Brown wielding a Sharp's rifle, smuggled illegally into the state in crates marked "bibles" and used to oppose pro-slavery raiders. Brown stands atop fallen bodies of both Union and Confederate soldiers, as the prairie burns and a tornado, sent, according the artist, by god himself, moves to smite Kansas's enemies.
 
If any state establishes a precedent for legally ignoring federal infringements of 2nd amendment rights (including NFA/GCA), I will find a way to leave this legislation happy state I call my home.
 
Not once in my adult life have I ever given even a passing thought of moving to Kansas. Until now. It might be cheaper to move there than to jump thru the hoops obtaining a full auto short barrel suppressed rifle.
