General Gun questions for a aspiring Gun owner in the NYC

I am an aspiring gun enthusiast who wants to start a collection. But I have a few questions. One: Is there a restriction against owning a S&W 500 (Bear hunting in upstate NY) in the metropolitan area? I also want to start off with a smaller handgun with reasonable stopping power just looking for suggestions on some inexpensive reliable options? Also I have a home in South Carolina do I need to apply for a gun license there too?
 
You can't have a handgun (legally) in Metro NY unless you have very low friends in very high places. And if you have to ask, you ain't got 'em.

IF all of your government issued photo ID shows your residence as the NY Metro area, no FFL will sell you a handgun (well, they might sell it to you ... but you can't take it with you)

If you manage to get a SC government issued photo ID with your SC address on it, you CAN buy a handgun in SC ... but don't even think about taking it home to NY.

When you get that SC Gov issued photo id with the SC address on it, let me know, I'm an FFL (In SC) and it would be my pleasure to be of service.

Sorry, but that's absolutely not true. They will put you through the wringer, but they will issue permits for premises, target, or hunting. The OP wants one for hunting, if he's clean he will get one.
 
Somehow I doubt that the old days of bribery and corruption are really gone. Or the days of organized crime getting permits by the dozen for its soldiers.

The old days involved talking to the individual precinct captain's bagman. Those days are long gone.

Everything is run out of 1 Police Plaza.

I'm not saying "VIP's" don't get special treatment, but the days of bribing your local cap't to approve your application are over. They have nothing to do with it anymore.

I think someone just set the record in NY recently. Someone had to wait 16 months and 19 days to get permission to buy a handgun in New York. Did I mention that this was in UPSTATE NY in rural Monroe county?

P.S. Its not just New York City that requires a pistol permit for purchase and possession of a handgun. This is law throughout the state.

While it's nice to know that someone realizes that NY isn't all paved with streets and parking lots, Monroe County has a population of 3/4 of a million and is mostly city and suburban.

But, yes, most of NY west of the Hudson river is far from being like NY City with diary farms, orchards, and vineyards in the Finger Lakes area.

For the purposes of gun ownership and purchase, if you own a home in a second state and live part of the year there, during the time of the year you are residing in that state, you are a resident of that state and may purchase and possess guns just as any other resident can. In South Carolina, no permit is needed for purchase and/or possession. You will need a permit to carry a firearm but it looks like you should be able to get one: http://www.handgunlaw.us/states/southcarolina.pdf

New York will be very tough. If you do follow through your plan to obtain the licensing and become a NYC-based gun owner and collector, please keep us updated on how the process goes for you. It is a long road, from all accounts. We wish you the very best of luck!

But if you get discouraged along the way, at least you'll be able to go visit your firearms in SC! :)

Yes, there are two New Yorks ... New York City and everything else. I'm orig from part of the "Everything Else" (finger lakes) .... but with what Eastern NY (IE NYC & Albany) has done to the entire state you couldn't pay me enough to move back there now.

Most of my family live in NY and I was raised there... Change your address at dmv, get a new licence, and keep your collection in SC. I've heard a few horror stories about law abiding family men and women being charged with felonies and being treated equally to hardened criminals because they mistakenly or unknowingly violated one of the many gun laws there. Some on which were arrested while/after they contacted law enforcement to inquire about what the law was and to get advice. The people who make the laws there do not want guns in their state, so they'll be more than happy to make an example out of you. If anything, at least you can start on your collect while during your 2 year wait for a NY permit...

If you do all your homework, have carefully filled out the application, and have all necessary documents, training, affidavits, etc., it's closer to 6 months.
 
Tagging this thread so that I can follow it. I've got popcorn in the microwave and can't wait for the show to begin.

Be careful with that "resident of SC while you are there" bit. I'm sure there are some interesting tax issues that go along with the interesting gun issues. Pay attention to both and make an informed decision.

The issues of gun ownership and residency don't have any bearing on taxation or legal residency for any other purpose. That's just how the ATF defines residency for the purposes of purchasing firearms.

In fact, it probably doesn't even necessarily affect how the state treats you regarding a carry permit. I'm not sure what states might view this in which way, but it is certainly possible that you may be legal to buy a firearm in your "second-home" state but that they won't issue you a resident carry permit because you already have state identity (and maybe resident carry) credentials from another "home" state. But some may. That would be an interesting thing to explore.

What I remember about SC CCW permits is that you can get a non-resident permit if, and only if, you own property in SC. You must be a legal SC resident to get a SC resident CCW. You cannot use a non-resident permit to purchase handguns in SC.

"If you own property in SC you can apply for a Non-Resident Permit/License. Non-Residents must fill out this Form and have the Assessor sign it to show you own property. Then follow the Application process as spelled out in the Resident Permit Section."

Well, no, you can't purchase handguns (and take them with you anyway) in ANY state where you are not a legal resident. However, if you have a home in SC and live there part of the year (and have whatever paperwork you might use to establish that) you can buy firearms there, according to the BATFE.

I know nothing about the legalities of firearms ownership in NYC, except for the fact that they are taking great strides to take it away altogether. My advice is on the particular firearms you're asking about. Before you buy anything, be VERY familiar with the laws and requirements.

First, have you ever fired a handgun? If the answer is no, then you wanting a 500 S&W is like someone who is about to fly a plane for the very first time wanting to fly a 767.
Not just anyone can handle the big .500.

As for what to start with, I would say a .357 mag revolver if you've never fired a revolver before. You can shoot .38 specials through it until you're used to that recoil, then step up to the magnums when you're comfortable. If you feel any discomfort whatsoever with the full throttle .357s, forget all about a .500 S&W.

And here's the relevant part:

Q: What constitutes residency in a State?
The State of residence is the State in which an individual is present; the individual also must have an intention of making a home in that State. A member of the Armed Forces on active duty is a resident of the State in which his or her permanent duty station is located. If a member of the Armed Forces maintains a home in one State and the member’s permanent duty station is in a nearby State to which he or she commutes each day, then the member has two States of residence and may purchase a firearm in either the State where the duty station is located or the State where the home is maintained. An alien who is legally in the United States is considered to be a resident of a State only if the alien is residing in that State and has resided in that State continuously for a period of at least 90 days prior to the date of sale of the firearm. See also Item 5, “Sales to Aliens in the United States,” in the General Information section of this publication.

As to how it works? You go see a dealer in your "second home" state and ask them what paperwork they need to see to establish that you're in compliance. It isn't terribly uncommon and they won't be shocked to be asked the question. After all...it's right there on the ATF's site.
 
i am so glad i left NYC and the island.. opened up an entire new world i forgot about when i left the army..

one of the best feelings i ever had was two weeks after moving here buying a gun in the parking lot of the central florida fairgrounds with nothin but a handshake and three $50 bills.. i hope you get all the info you need my friend. i gave away my northerner card in 98.. got the boots, hat and pickup truck to prove it..LOL

The funny thing is, I've always wanted to try living in NYC specifically Manhattan having a few friends there and some family across the Hudson (NJ). I'm in the medical field so finding a job is easy.

As soon as I found out about their draconian gun laws, I said forget that! I can't even have a pistol that has over 8rounds (loaded) even If I was able to own guns :eek:
