Selling and mailing a rifle from one State to Florida??

OK, I know this has been discussed but I am just too confused and old. I know handgun laws pretty well.:confused:

Here is the situation. If a friend who lives up North has a rifle he wants to sell to me. Can he just ship it by US mail to MY FFL (who will accept it for me) and not go through his FFL up North????

Is it only Federal law that applies or do some States (like Maryland) have their own hoops to jump through.

I know long guns can go by US mail but the question is can he not go through a FFL.

If someone has the ATF statute on this a link is appreciated.

Yes, he can box it up and ship it through either UPS, FedEx, or USPS since it's a long gun. Most FFL's will ask that non-licensees include a copy of their DL, along with a note with your name and contact info.
 
On your end it has to go to an FFL to do the transfer to you. The seller can get it to the FFL by whatever means is legal and will be accepted by the transfer FFL.

So since it's a long gun the seller may send it UPS or FedEx or USPS. The issue arises because some FFLs will not accept a gun for transfer directly from an individual. While it is legal for an FFL to do so, some will not for business reasons.

You should check with the FFL you're going to use for transfer on your end. Let him tell you how he wants to receive it and what documentation he'll want from the seller. As Bubbles mentioned, most will at least want a copy of the seller's drivers' license, current contact information and a note about who the gun is for.

I was unsure about the shipping STATE laws now that so many things have changed. I believe Maryland is going over to the dark side come October 1st.:(
 
While not absolutely necessary, it is best to have your dealer send a copy of his FFL to the shipper (Fax is OK) or to you to send it to the shipper. That way, the shipper will have proof that the gun is going to an FFL.

Buying insurance for the gun will require identification of the item. This may be a problem for the shipper, if not an FFL holder. The person behind the counter may not know the gun laws.

I live in Florida and have done the reverse, shipped guns OUT of state to various places.....the folks in the PO just look and smile and said nothing........at least at my PO, they're used to it

Neither UPS, fedEx or USPS requires "proof" that the shipment is going to a licensed dealer, nor do the require a copy of the FFL.

Nonsense.
I ship several firearms each week..........NEVER have I been required by UPS, FedEx or USPS to identify the item for insurance purposes.

Matter of fact, it is impossible to do so when printing a shipping label online at any of those shippers website.
 
Yes, I have read the stickies and the ATF FAQ.

My only real concern was if with the crazy STATE laws changing in some STATES if there was any laws that they concocted that would be contrary to Federal laws.

Every time I try to read it - my head hurts:banghead: maybe you can check it out a little more thoroughly.

As far as I know, the only effect the new MD law will have on non-regulated firearms is the 10 round limit on all magazines, chambers, etc.

But being from Maryland myself - I'll talk to my FFL and get back to you.
I have to meet with him anyway to fill out paper work on a new M67 - that a friend down there recommended.

As a side note, you should ship it FedEx ground. They do a good job, it's really cheap ($22 for a Garand), and they are professional about the whole thing. I have heard bad things about UPS and USPS breaking and losing things.

You have to do it at a FedEx shipping hub, not the store, but I was very impressed with the last rifle I sent to my gunsmith. I was in the building for about 7 minutes, and 5 of that was filling out the carbon copy form.

I receive dozens of packages each week from UPS/FedEx/USPS.......all three are just as bad/good as the other two. Understand that the majority of USPS Priority Mail packages will be carried by FedEx or UPS on a plane at some point.

Not true, FedEx tariff allows shipping from any FedEx Office location.
UPS on the other hand, requires a daily pickup account or shipping from a Customer Service Center. UPS does not allow shipping firearms from a UPS Store.

As far as been established, there is not problem shipping from your State and it's Federal law that applies. Maybe shipping TO your State will be a issue after 10/1/13
