colorado magazine law = becoming compliant

Hey guys,

I've been googling this for a couple days, but I'm not really finding the answer i need. what does it take to make a magazine compliant with Colorado's laws? can you just put a block of wood between the baseplate and the follower? completely disassemble the mag body/baseplate/follower and spring?

Im driving back home to Seattle, and driving through colorado would knock a good bit of time off my trip, but i have my M&P 9mm in the car, and i can't remember if i bought it early enough to be grandfathered in, and id rather not just mail the mags home.

any input is appreciated,

Quite a few firearms dealers have electronic files they could look through pretty quickly and tell you exactly when you bought the firearm. Then you would know for sure if you complied by the date or not. Couldn't hurt to call the dealer.
 
AFAIK, there is no way to 'make a magazine compliant' with Colorado law. And that might be why you can't google up a method for doing so.

If it holds 16+ rounds... either it was made before July 1, 2013 and it is legal to possess, or it was made after and it is illegal to possess.

(I) OWNS THE LARGE-1 CAPACITY MAGAZINE ON THE EFFECTIVE

3 (II) MAINTAINS CONTINUOUS POSSESSION OF THE LARGE-CAPACITY
4 MAGAZINE.
5 (b) IF A PERSON WHO IS ALLEGED TO HAVE VIOLATED SUBSECTION
6 (1) OF THIS SECTION ASSERTS THAT HE OR SHE IS PERMITTED TO LEGALLY
7 POSSESS A LARGE-CAPACITY MAGAZINE PURSUANT TO PARAGRAPH (a) OF
8 THIS SUBSECTION (2), THE PROSECUTION HAS THE BURDEN OF PROOF TO
9 REFUTE THE ASSERTION.
 
Which brings me back to my first point...

There is no way to 'make a magazine compliant' with Colorado law. Either, it has always been a legally possess-able magazine, or it never has been. The effective date of the legislation is what matters when possessing a 16+ round mag in this state.

Since the OP admits that he can't confirm the date of ownership, he's got to consider what the law says. If the magazine(s) were purchased after July 1, 2013, they are illegal to possess inside the state of Colorado.

You do realize that Mapul sells parts kits here, which consists of the magazine body, spring, baseplate and follower. You spend 30 seconds putting it together and you have a legal 30 round AR-15 magazine.

This is 100% legal!

Its a loophole that innovative companies like Magpul have exploited for the benefit of the citizens.

Do you drive over 55 every day, then you are breaking the law, every day!


I don't know where you get your information from but what you described is 100% WRONG.


18-12-303. Identification markings for large-capacity magazines
- rules.
(1) A LARGE-CAPACITY MAGAZINE THAT IS MANUFACTURED IN
COLORADO ON OR AFTER THE EFFECTIVE DATE OF THIS SECTION MUST
INCLUDE A PERMANENT STAMP OR MARKING INDICATING THAT THE
LARGE-CAPACITY MAGAZINE WAS MANUFACTURED OR ASSEMBLED AFTER
THE EFFECTIVE DATE OF THIS SECTION. THE STAMP OR MARKING MUST BE
LEGIBLY AND CONSPICUOUSLY ENGRAVED OR CAST UPON THE OUTER
SURFACE OF THE LARGE-CAPACITY MAGAZINE.

(2) THE BUREAU MAY PROMULGATE SUCH RULES AS MAY BE
NECESSARY FOR THE IMPLEMENTATION OF THIS SECTION, INCLUDING BUT
NOT LIMITED TO RULES REQUIRING A LARGE-CAPACITY MAGAZINE THAT IS
MANUFACTURED ON OR AFTER THE EFFECTIVE DATE OF THIS SECTION TO
BEAR IDENTIFYING INFORMATION IN ADDITION TO THE IDENTIFYING
INFORMATION DESCRIBED IN SUBSECTION (1) OF THIS SECTION.

(3) A PERSON WHO MANUFACTURES A LARGE-CAPACITY MAGAZINE
IN COLORADO IN VIOLATION OF SUBSECTION (1) OF THIS SECTION COMMITS
A CLASS 2 MISDEMEANOR AND SHALL BE PUNISHED IN ACCORDANCE WITH
SECTION 18-1.3-501.

The burden of proof as to MFG date is on the State. Did you buy it before July 2013?

Just so you all know: There has been approximately zero enforcement here of the new Law. I am thinking maybe one case.

Lock it in your trunk if you are worried. Don't attempt to sell the magazine.

In general, get a revolver.

You can have a loaded handgun in your automobile here. But not a loaded rifle.

What I did was have Walmart print a dated photograph of my two non-compliant mags prior to the effective date. Then I locked a copy in the Bank's SDB.
 
Does lack of enforcement invalidate a law? I don't think it does.

To OP the only way to make them compliant is to lower the capacity permanently. Unlikely an option for a pass through the state. You could always get a single 10 or 15 rounder and mail the others home.
