Question for Canadian Gun Owners

Hi guys. Returning to the forums again after a looooooooong hiatus.

I'd imagine that this situation is probably somewhat unique. I'm an American, and an uncle of mine (a Canadian citizen) who lived in Alberta passed away recently. When my aunt called us a few days ago to give us the news, the issue of where some of his possessions will go came up.

My uncle owned a couple of bolt action rifles and a double-barrel shotgun, which are still at his house, and I'd like to take possession of them and bring them back across the border. But I've got a few questions:

  • Can I legally do this, per Canadian law?
  • If so, what is the process that I can go through to legally take possession?
  • Does the scrapping of the long-gun registry have any positive effect on this? I know that these guns were registered long before it ended.
  • Could I theoretically get away with just taking them and bringing them through US customs normally, without any legal ramifications for my aunt?
  • If I can't do any of the above, is there some other way to keep them out of the hands of the RCMP, like having them sold to another Canadian citizen?
  • And last but not least: Are there any government websites that might give me more insight?
Also, if it makes any difference, these guns were probably made no later than the 1960s, and might even be older than that. I appreciate any help you can give me. Thanks.

Hmmm....right....I forgot all about those pesky US import laws. Didn't even occur to me, especially as I've never dealt with bringing guns across international borders. Thanks for the info.

The scrapping of the long-gun registry makes no difference one way or the other. In theory, those records were destroyed. Means the RCMP doesn't know about 'em.
You cannot just collect 'em and go home. Both your Homeland Security and our Border Services Agency would excrete bricks. You'd be in possession of firearms without a licence on our side and be trying to import firearms without the permits on your's.
Anyway, the executor of your uncle's estate has complete control over 'em including exportation paperwork, here. The executor can hold on to 'em, without a permit, for a "reasonable" amount of time with no fuss. That being defined nowhere, but it's plenty of time to deal with the assorted government interference. No idea how long probate takes in AB, but it can be a couple years in Ontario.
Those pesky US import laws are the real nuisance, but unless they're Lend/Lease rifles vs commercial hunting rifles it really shouldn't be too much trouble.
 
Yes.... I know someone who did this. I will PM the information of the FFL on the US Side, who works with the FFL on the Canadian Side....
 
Provided the weapons are not Prohibited Class in Canada or NFA weapons in the US, you should have no problem. You just need to find an exporter on the Canadian side and an importer on the US side.
