Getting very close to shipping.

I have an advance sample in lockup at my dealer.
I have a copy of the two-page letter from ATF to Mossberg buying off on the new model, but in my state a 14-inch NON-NFA shotgun is defined as illegal.

I've forwarded that ATF letter to the appropriate state agency in Utah for determination, the agent I spoke to will be conferring with the local ATF office about their reasoning behind approving the model to see if it could be transferred over to a statewide approval/exemption, and I should be hearing something later today or tomorrow.

These things should be available on the open market shortly, but check your local situation out VERY thoroughly before ordering one.

Have one on reserve order from Buds Gun Shop.

Hopefully I got my reservation in on time to meet the first production wave. I'd hate to have to wait for a new batch to be made and distributed.

Does the letter come with each Shocwave?
 
The state law difficulties are unfortunate. I have been considering buying one of these and took a very careful look at Wisconsins statute on SBS. while the definitions would seem to make possession of the shockwave illegal without a federal tax stamp, it also says it does "not apply to any firearm that may be lawfully possessed under federal law". Hopefully your state gives you the OK. If they do, i would keep proof of that with the gun just in case.
 
The gun sitting in lockup at my dealer is a T&E sample for a write-up.
At this point I don't believe Mossberg's including a copy of the ATF letter with each one, I got mine emailed separately from the PR contact who arranged the test gun, once the question was raised about legality when my dealer got the gun in.
That may be something that Mossberg should include.

I'm not entirely sure if I'll be keeping the gun after the write-up's done, assuming the state allows possession.
If I do, I'll for damn sure keep a copy of either it or a letter from the state agency with it. :)

Wording in your state statutes is critically important, as Ewlyon points out.

PGOs have very limited utility, which is why I don't know if I'll keep it or not.
I already have an NFA 870 with folding stock that fits the same space & allows aimed shots from the shoulder open, and tight close-in action closed.

Since it has interest for others, I'll do the review & let them decide.

In the meantime, need to get my state to decide what its position is going to be, both for me to use the test sample & for others to buy. :)

Email back from the state agent.
He conferred with the local ATF branch in SLC, who decided ATF is considering the Shockwave to be a handgun.

State agent is then saying, based on that, to have dealers run the 4473 & background check as a "handgun", not as a "shotgun".

If run as a shotgun, the transfer will be denied, if run as a handgun, it "should" be approved.

This is only a tacit indication the gun's legal here.
I'm trying to get it in writing, since it makes no sense.
Traditionally, a smoothbore handgun is an NFA item.

I've also asked if the state agency will be disseminating its determination to dealers & LE statewide, to prevent multiple dealer hassles & some poor guy getting himself arrested by un-informed LE & turned into a court test case.

Your state is going to pretend it's a handgun? And that won't cause any problems?
 
Room for all sorts of problems, which is why I'm trying to get an official letter & dissemination to LE agencies & dealers statewide.

So far, I'm apparently one of only four people in the state (one ATF agent, two state agents, and me) who "know" the Mossberg is apparently legal to possess in Utah, under state law.

The state agency here is now saying they will not render an opinion on the gun.
Which leaves it open to all sorts of dealer messes & false arrests.
Pursuing further, at the state legislative level.

Remington had one for good while at about $600. I wisely stayed away knowing I can get 18" 870 with shorter Hoge grip giving about same length w/o legal issue bag. As I said one doesn't really need dedicated HD shotgun, but if they want extra capacity mag the 18" or 18.5" barrel is the way to go.
 
Mossberg has shipped at least one, it's still at my dealer. :)

But- it won't be for much longer.
He & I are not willing to be test cases in criminal prosecutions, so until or unless we can prod the state into making a legal decision, he can't sit on it indefinitely, and I won't take possession even if he was willing to try to do a transfer.

Mossberg's sending a return label & it'll be going back to them.

Mine came in today-took it to the range and put both Aguila mini slugs and buckshot thru it using the OPsol mini-clip I had for my 590A1. I had no issues and it shot great. Will take it an indoor range tomorrow and try reg. lo recoil slugs and buckshot.
 
You guys should check out Black Aces Tactical. I think they were the first to get the ATF ruling on this. They make a pump that takes saiga mags and has a folding arm brace, since 2014. As far as I understand this, the "weapon" is classed not as a SBS or a handgun, but as a "firearm". It has to be made without a shoulder stock and its full length cannot be less than 26 inches. I think this is why Mossberg came out with their shorty this year. The ruling has been in effect for 3 years. Black Aces make their guns from Mossberg receivers. Oh, their guns have a vertical grip to work the pump.
 
Worked great with lo recoil buckshot and mini shot shells today. Mounted a scope rail and attached a Crimson Trace Rail Master laser upside down on it- will try it out in the morning.View attachment 232016

Awesome setup, bro. I just ordered one of those Opsol mini-clips and some Aguila mini buckshot and birdshot shells to try out. I plan to use it for home defense with the buckshot loads. Just waiting on Buds Gun Shop to send me my shockwave.

You guys should check out this new video from Clint Smith of Thunder Ranch where he reviews this gun:



He seems to consider it a serious defensive weapon, but stresses technique and safety to employ it effectively. I think this would make a potent RV/camper gun or for people in small houses or in other small buildings. Can't wait to get mine!!
 
I'm confused; under federal law, would this be considered a handgun, a long gun, or simply a "firearm"? Do you need to be 21 and a state resident to purchase this, or can you be 18 and from across the state line?
The questions regarding how it is not a NFA weapon are one thing, but what about all the rest? Anyone know?
