Current Wait Time For Permission Re: 5320-20

I believe technically you don't need to wait for "permission" for a permanent move out of state, but you are required to notify them.

You only need to wait for approval on temporary relocations of the NFA item. The reasoning being that ATF has no authority to hold up your moving to another state.

Now if just the firearm is relocating and you're not, you probably do need to wait for approval.

I'm not 100 percent sure if any of this is true or not, it's just what I've heard.

@ vsteve - I appreciate the response. What you say sounds logical, but history shows the BATFE's logic sometimes runs convoluted.

Does anyone else have some input either agreeing or disagreeing? If you agree with vsteve, what form is necessary for the notification?

Have you thought about calling them on the phone and having a conversation about it???

This is probably the smart thing to do. You can also "ask the experts" online if you're registered in the E-forms system.

To answer your question, I recently had some 5320.20s turned around in about 3 weeks, door to door.

Acera & Ryanaxia's suggestion about a phone call is probably the easiest solution for me and that's what I'll try to do tomorrow. I get back to this thread and pass on what I find..... Doc

@ GarrettJ - Thanks for the response. Is the 5320.20 the proper form for the permanent change of location?

Yes it is the correct form for either a temporary or a permanent move.

For a permanent move, check the "NO" box in Section 2 where it asks if the firearm(s) will be returned to their original location.
