Need LEO sign-off in Albuquerque NM area

I just spent the entire afternoon chasing a dream. APD (Albuquerque Police Dept) used to have a unit that dealt with the ATF Form 1's and 4's, but I found out sometime in the last 2 years they shut the unit down. I was then sent to NM State Police, whom refused to review or sign my Form 1's. I was then sent to the NM Conceal Carry Unit (?) and they refused as well. I was then directed to BCSO and they refused to deal with the forms.

What the hell? Who here in the Albuquerque, NM area has sent off a Form 1 or 4 to ATF in the recent past? Who did you get your signature from? Or do I have a lawsuit on my hands? Sounds like infringement of my 2nd amendment rights, but I'm just beyond pissed right now that I might have to travel out of town just to get a damn signature on 2 pieces of paper.

If anyone can direct me to some kind of LEO in my area that will agree to review/sign off on my forms, I would owe them a beer. Thanks in advance.
 
You no longer have to get them to sign, now that 41F has passed. You just have to notify them by giving them a copy of the form.

I think you must have an outdated form. Sorry, but you wasted your time when you didn't need to.
 
I have the updated forms from the website. So you're saying I can just send them in with the fingerprints? I found the information about 41F on the ATF website, but everything there is referring to trusts or legal entities. Is a 5320.23 required by an individual, or is it just for trusts/legal entities?

Nevermind, it states on the 5320.23 that the form is NOT required for an individual transfer. MIND BLOWN. I can't believe these changes took place. It's been over 2 years since my last transfer. I'll get the paperwork sent out this weekend. Thank you, Elkins45.
 
41F changed the rules, some good and some bad. The elimination of the CLEO sign off was the good. Making all members of a trust submit photos and fingerprints was the bad. The main reason I formed a trust was to avoid the hassle of prints, photo and CLEO sign off, even though getting a signature would have been easy for me.

Remember, ATF doesn't regulate trusts. Nor do they regulate the addition or removal of the members of a trust.
All they really care about is if a Form1 or 4 is submitted by a trust that all responsible persons listed on that trust submit fingerprints and photographs.
How to fix that onerous requirement:
If your trust allows you to do so......simply remove the other members of the trust before submitting your next Form1/4. Only your prints & photos would need to be submitted. When the tax stamp is returned, add them back. Those removed members cannot possess any NFA item registered to that trust until they are added back as members.
Or,
Create a new trust. It could be as simple as changing the name on your current trust document. If your current trust is the "Elkins45 NFA Trust", just change the name to "Elkins45 NFA Trust #2". Submit the form1/4 with your prints and photos. When the tax stamp comes in, simply add any members you want to the trust.

Silencer Shop actually sells a "single shot" trust that uses the serial# of the silencer as the name of the trust. It is fully intended that the trust would only include one NFA firearm.
 
If I ever buy another NFA item I will likely just do it as an individual.

Hopefully the next time I buy a silencer I will just pick it up out of the display case and walk out of the store with it...but I'm not holding my breath.
