I am a Virginia resident right now but already bought a house in Maryland and will move to there in two months. It is said I have to register my all handguns in police department, but I like to know whether I can keep any handgun which the magazine can hold 10 round such as Sig 1911 ,22 ?

Thanks.

Here's a few good places to start.

Always remember that forums like this are just a place where people can spread information. Nothing certifies that that information is correct unless the poster provides links to relevant sources to back up the information they provide.

bearcreek, Thanks.

I have a S & W 915 9mm pistol , it uses 10 or 15 rounds magazine, I don't know whether I still can keep it in Maryland and can sell it late ? I searched the link above and can't find the answer for my question. I also can't open the " approved handgun list in Maryland. ". Thanks.

I found this from MD gun law. "Illegal to purchase, sell or manufacture magazines with a capacity of greater than 10 rounds within Maryland. However, possession of magazines greater than 10 rounds is legal if purchased out of state. These may not, however, be transferred to a subsequent owner unless done so outside the state of Maryland." I understand my S & W pistol is OK, I still can keep any magazines I had already , but I can't sell the 15 rounds magazine to subsequent person.

Be very careful with that way of thinking.

The law you cite is for Maryland residents buying a greater than 10 round magazine out-of-state. That law does not apply to you because you are not a resident of Maryland.

Actually you are a non-resident importing magazines that are illegal to purchase in Maryland. Allowing you to bring 15 round magazines is contrary to the intent of the law. It may be legal but I would contact the agency responsible for registering guns and the owners and get the written statute that allows it.

Easy to get around that. If it's legal for Maryland residents to purchase greater than 10 round mags out of state, all he has to do is "sell" them to a buddy in VA before he moves and then "buy" them back when he becomes a Maryland resident.

Post #5 is correct. Bring them in now or later, just can't buy or sell them when in MD. PA gun stores sell regular capacity mags to Marylanders all the time.

Note that it would also be considered illegal for you to arrange any such transaction whilst you are physically in MD. Calling or emailing and asking somebody to meet you in VA or PA to hand you the mags would be illegal if either party is physically in MD.

It doesn't make sense, but MD gun laws rarely do. Which brings up the question "Why would any gun owner move to Maryland", followed by the unsolicited and apparently tardy advice"NO, don't do it!"

I hope I am right that MD law bans greater than 10 rounds of magazine, so any pistol which only use greater than 10 rounds magazine should also be banned .right? but can another state resident who moved to MD still keeps this kind of gun or not allow?

Maryland law bans buying/selling/transferring such mags when one is in MD. A MD resident can go to another state and buy standard size mags to bring back to MD. A person with standard size mags who lives in another state can move to MD and bring said mags along, but can not buy more (or arrange to buy more) while physically in MD.

If you didn't want to leave to buy a bigger mag, you could have an out of state selller (need not be an FFL) pin or otherwise modify the mags so that they could only hold 10 rounds. You could then buy them while you are in MD.

Most statutes tend to tell you what you can't do, especially in MD. Reading the statute that says you can't buy or sell and noticing that it doesn't mention "import" or similar is about the best you can do.

So, if for example, it says:

A person may not manufacture, sell, offer for sale, purchase, receive, or transfer a detachable magazine that has a capacity of more than 10 rounds of ammunition for a firearm.

That would leave the option of bringing in a mag you already own, or scooting over to VA, buying one, and bringing it home. You'd want to be pretty sure that there wasn't some other law banning importation, but the chances are pretty low that you would find a specific law stating "efeng9622 is allowed to bring his or her mags from Virginia"

One could also note that the so-callled "assault weapon" ban enacted at the same time as the above includes similar wording, but also includes an additional statement that one may not "transport an assault weapon into the state"
