Florida Agriculture Commissioner Wants Pre-emption Gone

I have been petitioning my state reps to introduce legislation to remove CCW permit issuance from her purview. It never should have been placed under Ag. In the first place.

We have problems with phosphates, pesticide runoff, invasive species, crop blight, and even horse poaching- but our Ag. Commisioner only wants face time with the cameras to talk about banning guns.

Great job, Nikki. Good luck getting reelected.

She is worthless. Like Nightlord40K said, she has no problems with
runoff polluting the waters in Florida as well as the increasing number
of companies pumping millions of gallons of water out of our aquifer.
But she seems to have plenty of time to dick around with
gun laws. And yes, why is Nikki's office responsible for
CCW permit issue. From what I see in Florida, it is rapidly becoming
over run by people from NY and NJ who are becoming a huge
voting block in Florida and stupidly attempting to turn Florida
into what they left.. Really puts the 'duh' in Floriduh.

As the briefs point out, municipalities are nothing except creations of the legislature. They can do nothing that is not authorized by the legislature. Much like teenagers, Municipalities like to cloak themselves in the trappings of adulthood, but at they end of the day they only have what daddy gave them and they have to follow the rules of the house.

Nikki is a marijuana lobbyist who likes to blow smoke up her breathing hole. Not surprised she doesn't get it.

And she is in "charge of our CCWs

How did she do it?? We can thank Broward County once again!)

After grueling machine and manual recounts for the razor-thin race, Fried emerged victorious in the contest to replace term-limited Adam Putnam by just 6,753 votes — a margin of 0.08 percent. Caldwell asked a Broward judge Saturday to mandate the county to submit machine recount results to the state, which would give Republicans a net increase. That petition was denied, according to Broward County attorney Andrew Meyers.

Her platform:

First, she committed to a mostly nonpartisan campaign.

Second, she stuck firmly to three narrow talking points, or her "three w's": Weapons, weed and water.

Fried's campaign, which was heavily predicated on gun control and expanding access to medical marijuana, brought an understanding of the agriculture commissioner's role to those outside of the farming community. Or, in other words — Democrats, suburbanites and urban dwellers.

"These were things that transcend Democrats, independents and Republicans," Fried said of her platform. "I made them believe that I want to fix things and make things better."

The third key to her success? The "fourth w," she said: Being a woman.

Why doesn't Florida use the FDLE to issue CCW permits? How did the Ag dept get that? Texas uses the DPS to issue LTCs. Why couldn't Florida do similar and forget about Nikki Fried's drive for preemption. Doesn't sound like she's much of an Ag Commish.

Florida's Department of Agriculture (Nikki Fried at present) handles concealed gun permits because in 2002, the NRA had Tallahassee move the division of licensing (including concealed weapon permit program) from the Florida Department of State to the department of agriculture. That is why.

Part of the hullaballoo over this has stemmed from the actions of open-carry advocates, particularly in West Palm Beach and in Palm Beach. Several of these folks have taken to fishing off the piers with AR-type rifles slung over their shoulders in the downtown areas. While this is totally legal under Florida law*, the desired effect of "de-sensitizing" the public to the idea of seeing firearms carried openly isn't what's actually taking place. I'm all for open-carry being legal, regardless of whether or not I would practice it, but these folks had to know what the pushback would be, especially in West Palm Beach.

* Florida law prohibits open-carry in general, but allows for the possession of firearms, with or without a CWFL, while involved in a lawful camping, fishing, hunting, or shooting activity, or while in direct transit to or from such an activity.

ETA: The mere mention of "open-carry" in this thread is not intended to turn the thread into a discussion on the prudence of open-carry in general.

Interesting thread.... and from what I've read -sufficient info to oppose her re-election... Unfortunately for me I live in Broward county where conservatives (that label certainly applies to me - although I haven't belonged to any political party in many, many years...) have always been in the minority.... Lucky, lucky me... my representative to Congress it Debbie Wasserman What's her name....

I've had a concealed carry permit since the day I retired out of police work (1995...) and renew it every five years even though I've never carried a sidearm since I left the street... I've renewed it at every expiration since it's potentially an employment advantage if I ever came back to some form of street work. I can well understand why the NRA wanted the licensing done through the Agriculture Department since back then all the political stuff would be well expressed in the other agency. Like most, I never considered for a moment that a liberal type would run for head of the Ag department - for "other purposes". I'm sure that eventually we'll see the lady running for governor.... Perish the thought...

By the way.. back in 2016 I'd have walked barefoot over broken glass to vote for our current president - even knowing that here in Broward it would be just a gesture....

Florida is a state in constant flux. Much of what defined particular portions of the state is gone or going. And quickly. Home and land prices are rising dramatically and paradise is forever lost to many. Suffice to say that sociopolitical factors will increase in issue and affect us all.
