ATF Reverses Course, Withdraws Guidance on AR Pistol Brace Reclassification

They'll be back, but today this skirmish went our way.

Here's the biggest reason for the withdrawal, but that wouldn't have happened without all the public comments and 2A groups critical of the subjectivity in the "objective criteria" the BATFE proposed (and that it would be discriminatory against disabled Americans) -

Forecast was, over 100000+ would kill it.

That was based on the groundswell of (negative) (- ) comments at or over 100000 during Pres O Admin re: banning 223 LAP ammo

I had an R representative who did not appear on that letter. I wrote to her this morning to let her know it caught my attention. Feel free to copy if your rep also needs to hear from you.

I'm writing about the ATF's recent attempts to "clarify" the regulations surrounding pistol braces with a letter that was ambiguous, capricious, and likely to turn millions of gun owners into felons. It appears this letter has been withdrawn for the moment.

I saw a letter this morning signed by 90 of your colleagues calling ATF's nonsense out for what it was. Given your pro-gun talking points when you ran, I was surprised at the absence of your name on this letter. I'd be remiss if I didn't ask: Where were you on this? While words are nice, action is what preserves individual rights, and this is no time for being in the middle of the pack. What specific actions will you and your staff take to ensure that you're leading the way when it comes to preserving the Second Amendment?

@psyopspec good for you to keep the heat on those that at the very least shown that gun rights are not on their radar by not being involved. If one doesn't receive a response from an absent representative from a letter such as yours, it should be spread far and wide. Actions not words are what we judge these men and women that "represent us." Make them pay in the next election for not being seen on that letter.

Both of my Representatives are found on that page, I need to write a response to them; stating my appreciation for their signatures on the matter.

So, how many times have they reversed this decision over the past 2-3 years? I find it hard to figure out which decision is being reversed.
 
the batfe will renew its assault on the 2nd Amendment after January 21st 2021.
This is kind of what I was thinking. I was wondering if it's not a situation where they will return with all this nonsense in the next administration. Then again, it might not. The current administration seems like it would go either way on it. We have too much government.
 
So does this re-set the date for which a brace becomes grandfathered in for free registration or does it still sit at Dec 18 which was the day I had planned to buy one with some spare cash and as a birthday gift to myself.
 
Non starter for me, I guess.

I've enough to consider moving through life being who I am and comporting myself as I do to ever be intrigued by attention-magnets like slam-fires, wrist-braces and the like.

Now, they have FULLY entered the realm in which a poorly informed L.E. type can climb square up my fourth point of contact and - even if contemporarily legal - can ruin my year directly or indirectly.

I've been sideways with L.E. before on they being misinformed by something so innocuous as a case head-stamp.

The real issue to take from this mess is not whether these goofy parts are legal to own and use on any given Wednesday but rather that the *legislation* by policy-letter or random individual interpretation must stop.

GOA sent me an Email touting this new reversal as a huge victory.....hmmm.

Is it? I will be happy once SBR's are removed from the NFA. I wouldn't even particularly care about AR pistols and SBR's if not for my wife and daughter and prefer a 16" carbine. I feel like the victory would be if we were more proactive and started pushing back harder for nationwide ccw reciprocity, getting SBR's off the NFA and started reversing these superfluous nonsensical laws. Flying under the radar and not drawing a bunch of attention to ourselves seems like it would be an effective technique but even that doesnt stop them from going after us, we should punch back.
 
Is it possible they were (the ATF) worried that should the issue go before a higher court at some point they’d revisit the idea that SBRs are common in military use now and would then be considered protected under the 2nd; kind of in terms of how SBS are registered in some part because they aren’t considered “traditional” military weapons? I’m assuming that the push to regulate braces wasn’t just some ATF bureaucrat spitballing but rather someone with clout approaching via back channels to say “hey, before Diamond Joe comes in wouldn’t you like to show you are doing your due and proper to get these deadly weapons out of civilian hands?”

Instead of worrying about whether or not something is a legal SBR - get rid of the separate status of SBR altogether.

Yes, exactly. I can think of a million things outside of but also including guns that are made in a full size, compact and subcompact. From trucks and cars, furniture, smartphones, handguns, etc.... this list could go on forever. The 18"-20" bbl AR is the full size rifle, the 14.5"-16" is the compact carbine and the 7.5"-11.5" is the subcompact pistol. Its seems we should just do away with the term SBR from the NFA altogether. It should be just like anything else, where a full size, compact and subcompact model is available.....and legal.

What is the difference between owning a full size pistol/subcompact pistol for better concealment and owning a full size rifle/subcompact rifle? I know what the legal difference is, just not why it matters and hasn't been addressed in the last what, 80+ years.

The ATF is a government bureaucracy. They aren't know for being staffed with people that possess one whit of common sense.
Having worked in a government bureaucracy I do not believe this to be the case. People who work for the government have the same amount of common sense as everyone else. What they also have is a reluctance to go against the wishes of the people who do their evaluations.
