Hi, Can anyone shed some light on the legality (or not) if I had to defend myself in a place that posted a sign "We ban guns here".
Thank You

Too many variables in your question to even take a SWAG at an answer.

As a starting point, what do the controlling statutes provide? Then what does any applicable case law hold?

That's true. The hypothetical is just that - too many free variables.

1. Does the incident agree with the local jurisdictions lethal force / SD laws?
2. Why is the gun present? Deliberate violation of the law?
3. You may meet the SD laws but still be charged with the gun violations. There are cases like that.

Before I close this or others comment, I give the OP a chance to be more specific to scenario, local laws and the proposed circumstance. Others hang back for an answer, please.

The Bernhard Goetz case is kind of an example. It's an old case in which Goetz shot four would-be muggers with a handgun in NYC. Of course, possession of the handgun itself was unlawful. I believe all that ended up with sticking to him was one count of the unlawful-possession charge. He had originally been charged with several other counts including assault and attempted murder.

I guess folks didn’t read what I said. OP PM me with an answer.
