New York gun law that restricted concealed carry rights blocked by federal judge

I would guess most people in NYC use some form of public transportation to get from point to point. Therefore, by leaving mode of travel restrictions in place practically no one can carry any way.

There's probably a legal/technical reason why this injunction doesn't mention public transportation but I can't imagine such a restriction on travel could pass muster once judged on merit.

When I grew up there my age group all depended on walking locally, the bus for longer distances in the same general area and subway for long distances (Brooklyn to Manhattan or the Bronx, etc). As we got older some got cars if they could afford one, which were useful for travel beyond NYC.

Public transportation is deeply integrated into the life of any NYC New Yorker. It's part of life there and to be told you couldn't exercise a constitutional right while using it would be the same in other places not being allowed to walk on a sidewalk or drive on a road. It would be an absurdity.

What has to happen as did in other places - is for legal carry to happen, nothing really bad happening, and eventually it will be generally accepted. Like all the sky is falling nonsense about first open carry and then unlicensed carry here in Texas. Nothing bad actually happened so the news story parade of horribles went away.

The real question will be if NY even recognizes this ruling, they have ignored others so I'm not sure this will stop them.

None of the plaintiffs indicated they intended to use the subway while carrying, therefore they had no standing to challenge the prohibition that related to subways. Sections covering other types of public transport were struck down, however.

The GOA would probably like to add plaintiffs who would carry on the subway. And other places not covered by the existing case.

If you are a New York resident and think your case might help, contact GOA and join the fight!

@GEM where are you?

Erie county, not near the NYC subway. I've had letters published in the local small town paper. Member of the relevant organizations. Write the legislators all the time. In TX, I testified to the legislature and got mentioned in the San Antonio, Dallas, Austin and Houston papers plus being interviewed for TV and then had that played in these markets.

Latest court round - no carry again. More legal mumbo jumbo to the next antigun court level. Then to Scotus, years before the law is undone - if ever - is the latest estimate. Bruen is seen as wonderful, pragmatically for NYS carry, it wasn't in the aftereffects - theory vs. practice.
