Illinois could pass the perfect AWB & High-Capacity Magazine ban case for SCOTUS

Illinois wants to pass this before Jan 10th and most likely will.

This could be the perfect case for SCOTUS because it contains an Assault Weapons Ban, High-Capacity Magazine ban, and age purchase restriction all in the same law.



I'd rather SCOTUS with the current 2nd Amendment positive court take and AWB and High-Capacity Magazine case in 1 case rather than only one of the bans.

"'We’re not going to negotiate. I’m here to tell you if House Bill 5855 or anything remotely like it passes, we will see you in court,' said Todd Vandermyde, a former lobbyist for the NRA."

Things may have changed at SCOTUS, but I think they like to dissect cases into single micro-issues instead of the broad Constitutional matters we want addressed.

"Well, OK, you can accidentally have an empty .22 case in your car where the police can find it, but only if you've had your fingernails trimmed at a licensed manicurist in the last thirty days" seems to be the tone and tenor of their pussyfootin' around.

So this issue may dissolve into five separate cases, and a functionally illiterate SCOTUS will dope out a way to not grant cert on four of them.

In the meantime, we've spent dollars and person-hours on the whole legislation, which is an inherent part of Illinois' strategy: delay, obfuscate, propagandize, and... oh, let's say "infringe..." on the arms issue.

Each of us should send SCOTUS members a dictionary.

That's the game being played by the Blue states.
Throw together a sweeping anti-gun package, get it passed, it gets tied up in the court system for years, then gets ruled against and tossed out.
Then said Blue state changes a few words and conditions in that same package and passes it again.
Shampoo, rinse and repeat - indefinitely... .
 
Some of the language in the new bill looks to be much deeper than "AW" too.
From memory, it's all self loading rifles able to accept a magazine holding more than 10 rounds. If there was a tube magazine carve out, I will have missed it.

The bill also appears to limit the ability of those younger than 21 to go hunting, too . . . So, 4-5 counties trying to overrule the other 96.
 
The more egregious, the better. Pass it, get struck down by the Supreme Court, and that might keep them at bay for at least a few years.
 
And the nanny states continue to hone their gun laws as they witness the successes in New York, New Jersey, California, Oregon and Washington. Washington is doubling down as soon as the new legislative session starts next month and it's clear all these states are operating from the same playbook.

For those betting that SCOTUS will sort these messes out to our satisfaction, I'm offering both spans of the Narrows bridges for sale, cheap, after the holidays.

These states are playing the long game and can keep doing this, year after year, and by the time one of these cases makes it to SCOTUS, the court will already have been packed or its make-up changed totally to favor the other side.

Sorry to be all doom and gloom, but I just don't have the faith in SCOTUS some of you all seem to have...
 
I’ve had my FOID card for 50 years,CCW since inception, 03 FFL for over a decade. If I have to register a collection of firearms with the state police to keep them I will. I’ve been doing it legal all my life. Becoming a felon at this late date servers what purpose? I communicate with the ATF and my CLEO on a regular basis. I carry renewable photo IDs and have been finger printed.They know where I’m at. I will comply quietly, the majority in my state has spoken. Hoping to be saved by a few DC judges is not worth the risk of flaunting a new law. IMHO
 
Not me, I'll fight it through all means necessary. Shall not be infringed. I have a great job and family here. I will make all arrangements to sell assets and secure employment in a neighboring state. They can lose further tax base I guess. Im not paying to register my legally purchased items because of wacko leftist policies. Final straw.
 
Too darn bad it has to come to this. Wish the logic of the Electoral College applied to laws regarding basic rights. One county, one vote? We are being ramrod fed by a billionaire with armed bodyguards who has never had to work, make a payroll or defend himself in his lifetime. But he knows what's best for us, and mark my words, wants to decide what's best for the country....wait two to six years and see.
 
There is an interesting notion being forwarded by SAF, GOA and the like, that "we" ought not tell lawmakers when they put stupid stuff into their anti bills.
As that makes it far easier to have them overturned, entire, in the courts, where logic and facts still have (some) credence.
I'm not quite sure I'm on board with that as a notion or political strategy. But it does compel after a fashion.

If you "register" them, expect to lose them sometime down the line. Connecticut had "grandfathered" AWs in years ago and now the governor says that those grandfathered guns should be "removed from the state".

Registration is always confiscation. There is really no other purpose. Everything is eventual. When it doesn't happen in a year, or five years, everyone says," See? These Democrats just want some common sense gun laws to save kids lives. Let's reach across the aisle, guys." It's the long game. That's why the "gun show loophole " is always front and center. Bad guys grit their teeth every night that in much of free America, folks can still meet up, exchange gun for gun, or paper for gun, and be 100% inside the law. It used to be like that here as well. Hang onto that if you've still got it. I suppose we'll see in another couple weeks how this all shakes out. One good thing about ole Illinois, if one does have to flee to avoid running afoul of anti-constitutuonal laws, really any direction is an improvement. Iowa? Sure. Indiana? Why not. Missouri, I love the Ozarks! I won't miss being fined and carded to exercise my 2nd amendment rights, that's for sure! My free speech card should be in next month, still waiting on the background check...I guess they found some questionable posts on a website from a few years back so it's up before the dept of equity and justice for review...crossing my fingers!
 
This bill bans hundreds of semi-auto rifles and pistols. No grandfather clause for those who already own them legally. The moment the bill passes and gets the govs signature, an owner has 300 days to register each banned firearm with the Illinois State Police and fee is required to register the firearms. No FOID cards will be issued to those under 21 and all under 21 who currently have a valid FOID card will have their cards revoked. Anyone who owns banned firearms that are not registered or anyone under 21 who owns firearms with a revoked FOID card will be a felon.
Correct - it could end up in the Supreme Court. But how many years will that take and how many law abiding citizens will pay a terrible price in freedom & legal losses before it is ruled unconstitutional?
 
I stumbled across a show called Chicago in Crisis on Fox Nation. I made the mistake of watching it, as it was pretty disturbing and graphic. The fact that the powers that be in Illinois allow this barbarism to continue while focusing their energy on legal gun owners is evil, and I don't use that word lightly.

Even when it is rulled unconsitutional, unless Washington is controlled by some faction that cares IL will just ignore the court rulling without concequences.
 
Delaware passed these very laws that Il is considering last year! If you have a ccw license then you can legally have magazines over 17 rounds. Prior ownership of an assault weapon is grandfathered sort of. All went into effect on the Govs signature, no implementation period. All are being challenged in court now.
