Texas CHL Prohibited Places

Now that I have my CHL, I am paranoid I'll carry into a prohibited place. With 13 categories to worry about, rather than try to memorize, I thought I'd make up a little laminated card to keep in my wallet next to my license. Here's what I have, it will be front and back.

Texas Firearm Prohibited Places
1. Public or private schools, school sponsored activities, school vehicles, unless permitted in writing or by written regulations.
2. Premises of public polling place on day of voting or early voting.
3. Government court or court offices, unless permitted in writing or by written regulations.
4. At a racetrack (and possibly on racetrack parking lot).
5. In a secured area of an airport (except when in checked baggage).
6. Within 1,000 feet of place of execution if you have received notice it is prohibited (except while driving on public road or while at home or work).

Texas CHL Prohibited Places
1. On premises of 51% establishments.
2. On premises of high school, collegiate or professional sporting event.
3. On premises of a correctional facility.
4. On premises of hospital or nursing home, without proper authorization, if proper notice is given.
5. In an amusement park, if proper notice is given.
6. On premises of established place of worship, if proper notice is given, or you have received actual verbal notice.
7. At any meeting of a government entity, if proper notice is given.
(“Proper Notice” means the 30.06 sign)
(Premises does not include parking area)
 
That's cool and all, but you don't really need to memorize that many places.

Do you often visit a correctional facility?

Secured area of an airport? You need help to remember that one? :what:

Bars? Not restaurants, bars, ie 51% places. Should be common sense there too.

The church you can not worry about, they are subject to the same 30.06 sign requirements as any other place now. That language was added in but the bottom line is they must post the sign.

Same with hospitals. They are nothing special unless they post the 30.06 sign. Nothing to remember there either.

Polling places? Not often enough to worry about. Will you remember to look at your laminated card if you are going to vote?

Same with amusement parks.... gotta post the sign. No sign no problem, just like anywhere else.

The church, hospital, and amusement park pieces of that were originally prohibited places.
Rather than rewrite the whole statute they just added the "without proper authorization, if proper notice is given" wording. It basically erases them from the prohibited places list and puts them in with everything else. No sign no problem.


You're heart is in the right place but you will soon get comfortable with carrying and it won't be such a big deal anymore.

Pardon the hijack, but on the same subject, where's a decent place to go in the DFW-area for a CHL-course?
 
There is an excellent CHL school....

in Grand Prairie, Academy something. Can't remember. They provide everything, including the guns and ammo.........I am sure it is in the GP phone book........chris3
 
also note

the 30.06 sign must be properly displayed.
when my mom was in the hospitol i went to visit her entering at the door near the cafeteria (no sign), went to pick up my wife who was staying with mom for the day and found a 30.06 sign off to the right of the #1 entrance, so i just went back to the cafe enterance (no sign) and went in. prove that i saw that sign at enterance #1 when the other 7 doors have none!:banghead:
 
I just don't take mine to work (fed property), school or the ballpark. I don't frequent bars, so no problems there. That's about it, any accidental breaking of the rules, I just don't worry about.

I have only seen a proper 30.06 sign on a handful of occasions. Note that it must be in English and Spanish and 1" tall block letters. The sign you see at most places "The unlicensed possession of a handgun..." is not proper notice. It is just that - unlicensed.
 
" (and possibly on racetrack parking lot)." don't think so unless it's posted. The only parking lot I've seen posted is at Planned Parenthood Waco.

Two years ago the DPS CHL attorney told us that absolutely nobody had been prosecuted for carrying under license in a prohibited place. She attributed it to our very law abiding nature. It might also mean that nobody has gotten caught.
 
Section 46.03 lists the prohibited places, and the way you have that written makes it seem you cannot carry on the grounds of a school. I carry all the time at college on the "grounds", I just can't enter the buildings while carrying. Now in Houston where the DA is a fascist Nazi type you will probably be charged and it later dismissed which will cost you some $$$.

"Premises" means a building or a portion of a
building. The term does not include any public or private driveway,
street, sidewalk or walkway, parking lot, parking garage, or other
parking area.


Are you interpreting the "grounds" language to not apply to campus because there is no "activity" there?
 
No guns at a high school football game in Texas?

Without a gun, what are you going to shoot in the air when your team scores a touchdown?

Or an interception... Or a 1st down... Or a gain of 2 yards... Or...

Yes, The key word is "activity" being conducted. That denotes an "event" such as a football game and not everyday activity in my understanding.
And since the "safe school , gun free zone whatever" crap got shot down I don't have to worry about the feds either- yeah!

I don't think so because I recall reading somewhere (I think it was here) that they rewrote the law to include a newstandard ICC reference, "a weapon that has traveled in or substancially affects IIC", and put it back into play. It hasn't been used yet or challenged but even after the Lopez defeat, it is still out there from my understanding. In light of Raich, who knows how it could go.

Could be wrong though...
