Fourth teen didn't take part in burglaries, detectives say

One of the teenagers nabbed at gunpoint by state Sen. Tim Burchett won't face charges, but the Knox County Sheriff's Office said three others have been charged with burglary.

Burchett, R-Knoxville, said he caught the four boys Wednesday breaking into a warehouse at 2000 Amherst Road where he keeps motorcycles and spare parts.



He said he held them at gunpoint with a 9 mm Glock pistol, marched them to a nearby parking lot and fed them chocolate-chip cookies until KCSO deputies arrived.

Burchett said he got tired of repeated break-ins at the warehouse and suspected teenagers might be involved.

He staked out the spot Wednesday after learning Karns High School had closed for the day because of plumbing problems.

Burchett called 911 just before noon.

"There's somebody breaking in my warehouse right now," he told a Knox County E-911 dispatcher. "My name's Tim Burchett. I'm a state senator. I'm just telling you that so you don't think I'm a nut. I'm going to jump on them. I'm going to pop 'em."

"You're talking about shooting them?" the dispatcher asked.

"No, no, I'm not an idiot," Burchett said. "I know the law. I mean pop 'em - I mean catch them."


The oldest teenager, 18-year-old David Wayne Bates of Knoxville, faces two charges of burglary. One of the charges relates to Wednesday's break-in and another to a break-in at the warehouse Sunday, according to court records.

The other boys' names weren't released because of their ages. Investigators determined one boy, a 14-year-old, didn't take part in the burglaries, KCSO spokeswoman Martha Dooley said.

Authorities gave different accounts about the other two teenagers. Dooley said a 15-year-old and a 16-year-old admitted to the break-in and were charged - one with four counts of burglary and another with two counts of burglary. She said reports didn't indicate which boy faced which charges.

Larry Gibney, director of Knox County Juvenile Court services, said one boy - the 15-year-old - had been charged with four counts of felony theft and three counts of burglary. He appeared Thursday morning before Juvenile Court Judge Tim Irwin and was ordered held at the Richard L. Bean Juvenile Services Center until a delinquency hearing, which hasn't been set, Gibney said.

Dooley said investigators believe three dirt bikes were stolen at various times from the warehouse. One ended up as part of a shop class project at Karns High, and detectives found another at one of the boys' homes Wednesday, she said.

Investigators haven't found the third dirt bike yet, she said.

Possibly brandishing if happened here, unless he made a citizens arrest. Even then, his life was not in danger. I would think it would be up to LEO on scene and then maybe "post tramatic stress" civil suit for pointing a firearm at a minort:barf:
 
In a lot of states you would go to jail for that. In DC you would go to jail for that for SURE.

Glad he did it though :) I would probably get in trouble, but then, I'm no senator.
 
That's a pretty cool senator! I do agree he may get preferential treatment for his little stakeout.

What he did was all fine and good in TN. Brandishing is if you display to threaten someone illegally. If I had done this, I might have been given the lecture about doing a cops job, but I would be in the clear. Granted, I would have probably been more likely to make them lay face first in mud without the offering of cookies.
 
Yah as long as you are protecting your property in Ca its all good...but then the cops suck here. Well atleast in my area.

State Sen. Tim Burchett says he foiled a burglary of his warehouse on Wednesday and held the suspected teenagers at gunpoint until authorities arrived.

The Knoxville Republican said the warehouse where he keeps old motorcycles and parts had previously been burglarized and he was trying to catch the perpetrators by staking out the woods nearby, The Knoxville News Sentinel reported on its Web site.

The teenagers had broken off the lock and were about to go inside when he confronted them with his pistol.

"I got four of them. One got away," Burchett said, although deputies told him the fifth was arrested...

...later. "I think that's pretty good. I'm sick of crime. I'm sick of being a victim. I've been staying up at night trying to catch these guys."

Knox County Sheriff's department spokeswoman Martha Dooley confirmed that the teenagers were arrested, but said a report had not been filed and she could not give details.

Burchett told the newspaper that three motorcycles and a security camera had previously been stolen, apparently after school hours.

When he spotted the teens Wednesday, he said he called 911 to tell them he was armed and planned to confront the suspects.

"The lady said, 'Are you going to shoot them?' and I said, 'No, I'm notgoing to shoot some kid over a dad-gum motorcycle,'" he said.

Burchett said he told the youths to "put your hands up" and then to "put your hands behind your head."

"One of them said, 'Well, which one do you want: Hands up or behind the head?' and I said, 'Either one,'" he said.

The senator was re-elected last week without opposition and has served in the state General Assembly for eight years. He holds a concealed weapon permit and owns two pistols: a 9 mm Glock and a .25-caliber Keltec.

The question I have is, did he have the time to bake them before the cops arrived? :p

Also, if he's caught four teens breaking in, and he's got four at gunpoint, how is it that one of them "didn't take part in the burglaries"? What, he was just passing through? :confused:
