Police to report dead man to prosecutors over pistol, machine gun found in home

YOKOHAMA -- A pistol and machine gun were found along with a stash of bullets at the home of a 52-year-old man who was found dead of illness at his home here in May, prompting police to report the dead man to public prosecutors.

Police plan to report the man, who died at the age of 52, to public prosecutors on Wednesday, accusing him of violating the Firearms and Swords Control Law.

Investigators said the man had lived alone. When his 55-year-old sister, who lived nearby, visited his home in Isogo-ku, Yokohama, on May 28, she found he had died of illness.

The following month, when the man's sister and nephew were cleaning up the home, they discovered an attache case in a draw in the study on the first floor. Inside they found a Swiss-made handgun and 159 bullets.

Police who searched the home after the receiving a report on the handgun also found a bag containing a Swiss-made machine gun loaded with 20 bullets on the second floor of the home, and seized both weapons. (Mainichi)

I'm sure there is a logical reason, but I do not see the point in referring a dead person for prosecution.
 
Perhaps Japan has a Zero Tolerance policy for anyone found in possession of firearms. If so it might not make any difference whether the person is dead or alive: he has violated the law and should not be an exception to it. In that case he should be tried and, if found guilty, ought to receive the maximum sentence. If that sentence involves a long term in prison the Japanese government will have little expense for the incarceration. It won't cost anything to feed him and very little to house him.

Rational people find much entertainment in observing the application of Zero Tolerance policies. When the exercise of human judgment is prohibited, the operation of human stupidity comes to center stage and performs a dumb show that is much funnier than any other farce.

I don't see much difference between the Japanese police reporting a dead man for violating the firearms laws and the recent report of a U.S. school principal suspending a child for a badly drawn sketch of a handgun. The languages are different but the mentality seems similar, and nothing is lost in translation.
 
My guess is that this guy had a substantial amount of money, and Japanese law allows for criminal offenses to survive death--thus rendering any (massive) fines payable by one's estate.

Not so good for the civic-minded sister.
 
I am in complete agreement with Robert Hairless and Spiggy.
The guy got away with it and now he's dead. Let him rest in peace, or do the really decent thing and bury his firearms with him instead of destroying them.

I thought Japan had a vibrant knife/sword culture.
Isn't that where the "Kill Bill" folks got their swords?
If he is found guilty I wonder what his punishment would be.

The point isn't to punish the man, the point is to draw attention to the fact that his family produced a person that was deviant enough to break the law.

Japanese culture is really different from western culture.
