My thanks to everyone who took the time to contact IRS/BATF/lawmakers regarding Sugarmann's fraudulent FFL.

EZ FFL check is now listing his license as expired.

In a month or so I'll pull BATF's master FFL list to confirm that he hasn't simply acquired a new number, but in the meantime, it appears we have prevailed.

Huzzah!

You should call him back. Tell him that you'd still be interested in executing the transfer but you need a copy of his BATF Letter of Continuing Authorization.

So, now the records get turned over to the ATF.

FOIA request? Might be interesting to see what they've been doing with it.

I should hope not. Unless you think anybody should be able to request the records of any FFL and publish every person's gun purchases. 4473s may not fall under FOIA anyway.

$5 if the VPC tried such a stunt this entire board would be crying bloody murder.

I *think* the FOIA was worded so as to request audit results (records subject to public inspection that contain no identifying information), and not the form 4473s, which are not kept by the BATF unless the FFL surrenders them when going out of business.

rkh:
FFLs are required to turn the 4473s over to the ATF when they do not renew their license or otherwise go out of business.

FFLs are not required to surrender their 4473s. They can turn them over, or agree to hold them for the requisite statutory period (20 years?).

If I have time tomorrow to research the topic, I'll write on why surrendered 4473s are not subject to public inspection.

Also, I think this is an appropriate time to point out that I am listed as an "Exmember" because one of THRs mods took offense at... my discussion of a FOIA request. Oh, the irony.

(C7) What records am I required to forward to ATF upon discontinuance of my business?[Back]

The records consist of the licensee's bound acquisition/disposition (A/D) records, ATF Forms 4473, ATF Forms 3310.4 (Report of Multiple Sale or Other Disposition of Pistols and Revolvers), ATF Forms 3310.11 (Federal Firearms Licensee Theft/Loss Report), records of transactions in semiautomatic assault weapons, records of importation (ATF Forms 6 and 6A), and law enforcement certification letters. If the licensee was granted a variance to use a computerized record-keeping system, the licensee is required to provide a complete printout of the entire A/D records.

[27 CFR 478.127]

Great so they pulled the FFL.

The more important question is are they going to pursue any criminal charges? Or is the waffen BATFEces going to excuse their useful idiot's conduct?

 Just checked today. New FFL issued under the same number expires 3/1/2011.

I won't lie, I checked hoping you were wrong. Sadly, you were correct.

License Number: 1-54-XXX-XX-XX-00725

Expiration Date: 03/01/2011

No, you were listed as an ex member because you requested to be listed as such. I see that you're back now, so I'll make the change.

Cronarch:

I returned to enlist help of this site's membership with the Sugarmann FFL business. I posted similar messages on other gun boards. Now that it is concluded, I'm done. In retrospect, perhaps I should not have posted here at all.

I respectfully request that you either return me to ex-member status or apologize for the hamfistedness of the moderator responsible for locking my thread on the 6.8 FOIA request.

You can return yourself to ex-member status by ceasing to post, if you wish.

Mike

Sugarmann FFL

Does anyone know how to access this on line? I recognize that this is a bit old, but I would like to find a way to verify the Sugarmann FFL and its cancellation by ATF. Very best to all.

So, who does he sell guns to?

I bet that they only buy them for themselves to be used for anti-gun work-related purposes, or something to that effect. Or maybe they have it as a legal fallback for gun buy-up and similar 'safe neighborhood' activities.

Can anyone direct me to the start of this discussion? It looks interesting to me but I have no idea what is going on. Tried Search with no luck. Thanks, Jim
