I'm considering applying for an FFL in the near future... Where I'm at in Wyoming it's not a problem.

My question is about the feds. Anybody gotten an FFL in their residence lately? I have a separate shop in the back that I would specify as the business premises so they would have no legal right to enter my residence for inspections or whatnot.

Any input?

What is your property zoned for? If it's residential, you'll have a problem but you should be ok if its unzoned (or any of the other equilvalent terms).

Just sent the 07 paperwork three weeks ago. Check your zoning first. We also got all of our state/local business licenses and incorporation paperwork done before filing for the FFL.

Also check with your homeowners insurance to make sure you're covered to operate a business out of your home. We had to purchase additional coverage.

When you both speak of hangups with zoning... which level of government are you referring to? Feds? State? Local? The reason I'm asking is that our state does not regulate FFL holders, and my local area treats it as any other business. I'm mainly interested in the federal perspective....

Zoning is usually at the county level, and the ATF will be checking to make sure your business permit and zoning are in order.

I'm zoned res, but my local area has no problem with issuing a business license to a home. They don't want warehouses in backyards, but a license is fine.

Are you saying the ATF will have a problem with a res zoning even if my local area doesn't?

I just posted about this, I missed this thread.

I'm getting my FFL right now using my residence as my place of business and it's not an issue at all. The ATF will check on the zoning, so make sure you're 100% about it before you even apply.

What is ATF's concern with zoning? Do they just want me to be legit with the local area, or will they not issue an FFL to a structure zoned residential even if it's ok with the local government?

Its a leftover from Clinton's push to make getting an FFL as hard as possible and eliminate "kitchen-table" dealers.

It's literally just to make sure you're not violating any local zoning ordinances. It's got nothing to do with being zoned residential, I'm zoned residential and it wasn't an issue.

Ok.... so it sounds like I'm good. I've been living in CA for the last several years, and the CA DOJ would not allow licensing of anybody who wasn't in a commercial building. Wyoming is arguably the most gun-friendly state in the nation, so this state is not my concern at all. I just wanted to make sure I was good to go with the feds.

Thanks for the feedback guys.
