WA State AFL issue, FBI "fumbling the ball"

I have been following the gun bills that didn't pass in Olympia.

They don't know the different classification of immigrants.

The comment they had was 'as long as this doesn't allow illegal aliens to ...'
Then it was explainted to them that federal law covers that and the new then bill doesn't allow illegal aliens ...

At the end the bill didn't pass.

Also they had a member from DOL, who said this bill was important to pass and they are blocked.
 
well it still needs sorting

this still needs sorting out and it would be better for all the legislators if they did it sooner rather than later.

this is the US dept of justice take on this kind of law .

The U.S. Department of Justice Civil Rights Division is the institution within the federal government responsible for enforcing federal statutes prohibiting discrimination on the basis of race, sex, disability, religion, and national origin. The Division was established on December 9, 1957, by order of Attorney General William P. Rogers, after the Civil Rights Act of 1957 created the office of Assistant Attorney General for Civil Rights, who has since then headed the division. The current Acting Assistant Attorney General for Civil Rights is Grace Chung Becker who succeeded Wan J. Kim.

Section 102 of the Immigration Reform and Control Act of 1986 (IRCA), as amended, which prohibits discrimination on the basis of national origin and citizenship status as well as document abuse and retaliation under the Immigration and Nationality Act of 1952.

In addition, the Division prosecutes actions under several criminal civil rights statutes which were designed to preserve personal liberties and safety.

Deprivation of Rights Under Color of Law, 18 U.S.C. § 242. This provision makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States.
For the purpose of Section 242, acts under "color of law" include acts not only done by federal, state, or local officials within the their lawful authority, but also acts done beyond the bounds of that official's lawful authority, if the acts are done while the official is purporting to or pretending to act in the performance of his/her official duties. Persons acting under color of law within the meaning of this statute include police officers, prisons guards and other law enforcement officials, as well as judges, care providers in public health facilities, and others who are acting as public officials. It is not necessary that the crime be motivated by animus toward the race, color, religion, sex, handicap, familial status or national origin of the victim.

The offense is punishable by a range of imprisonment up to a life term, or the death penalty, depending upon the circumstances of the crime, and the resulting injury, if any.

So if I were the legislators I would get a memo out to all depts to disregard RCW 9.41.170 as it is worded until it can be fixed , otherwise if someone gets convicted on this felony they are going to have a problem .

If I didnt have a wife and kids to look after I would wander down to the local sheriff ,slap a gun down on the table and say "charge me " "give me my day in court "
 
that is interesting but you see that it says ..

"It shall be unlawful for any person who is not a citizen of the United States, or who has not declared his intention to become a citizen of the United States,

what exactly does that mean ?

apart from that the immigration act of 1952 should have overruled that.
Not only that but immigration procedures have changed a huge amount since then , I'm not sure if there were even background checks back then , certainly back then if you got married to an american citizen you were automatically in.

From simply the fact that they have reworded it for the new bill that has yet to be passed that tells me that they know that they are wrong .
 
hey batman anything you can do to help will be most appreciated , whats your situation ? are you a legal alien in wa or a concerned citizen ?

from what I can see so far we have a pretty good case for racial discrimination and unconstitutionality , but the law is a strange thing and not always easy to find what you need , it took me ages to find that one 1994 bill with the exact wording on it , there could be more to the immigration act that clears them or at least gives them good grounds to make this law .
until I can get a letter off to the dept of justice and get a reply then we wont know for sure .
other than that we will have to wait till next year and hope that bill 1011 passes.

staff counsel says the same thing that you already knew - so this isn't
new to you - but I wanted to share it with you anyway.

A resolution to this problem will be looked at - we thought the bill
would do it - but obviously it needs more work.

Here is a short summary on why the Department of Licensing is not able
to access the National Crime Information Center (NCIC database of
criminal justice information maintained by the FBI).

Federal regulation requires that only an agency that is certified as a
"criminal justice agency" (CJA) has access to the NCIC. In order to be
classified as a CRA, the agency must function as an investigative
authority. It appears that the FBI, despite what the law we passed
stated, doesn't think DOL is truly trying to access the database for
criminal justice purposes and is consequently denying them access.


Since the FBI is the one who is in control of this information, they
have the right to do this. I hope this helps. Please let me know if
you or the constituent have further questions.

So going back to the letter from Cathy McMorris, that the FBI sent to her.. the FBI told WA State .GOV what needed to be done, they did it and the FBI is still playing games. :banghead:

No wonder nothing ever gets done, each .GOV Agency is a kingdom unto itself and it does not play well with others. :fire:
 
Wait all you want, it ain't gpnna happen cause they don't want you to. If you are thinking you will get your citizenship in a couple years, think again. That crap is so back logged since 9/11 it is taking people 5+ years from the day they file.

Any potential plaintiffs--those who are personally affected by this law--feel free to PM me, and we can see about getting the ball rolling on this, with or without the help of a national RKBA organization.

Sorry, but who is Alan? I would like to get in on this as well.
 
Alan Gottlieb is the founder of the Second Amendment Foundation, which is funding the lawsuit, along with NRA. Call him; they have a lead plaintiff, but are interested in hearing from other people who are affected by the AFL law.
 
MD do you have any new information.
I tried to find more info and here is what I found out. There are actually 2 lawsuits

1. NRA which will go after WA for not issuing and licenses.

2. WA is suing an Oregon resident who was stopped in WA without an AFL with a firearm in his car. SAF is helping out with this case. At the moment the case on hold, pending review on the Heller decision by the DA.

As I understand the actual licensing won’t be challenged.
