Maryland Laws. Hunting Etc.

I was wondering if anyone in MD might chime in.

Correct me if I'm wrong as I just spent about an hour trying to clarify some things about MD laws.

I understand that Handguns and "Assault Weapons" (AKA Scary Black Rifles etc.) are considered "Regulated" firearms in MD. But they are not illegal to own, there's just a longer waiting period and you can't buy more than 1 in 30 days.

Given that AK-47 and it's variants are Regulated as Assault Weapons (I hate the Lib BS term but that's what they call them), can a Lawful owner in say VA transport a legal-to-own firearm that is classified as a "Regulated" firearm, into MD to use for hunting or target shooting?

Are there any hoops to jump through or stupid courses to take or a small fee to pay?



Hypothetical:

Saiga-12 Shotgun. W/ 5-8rd Capacity for Deer (Hunting Regulation). It's an AK-47 and thereby an "Assault Weapon". Can you bring one in to use as a hunter? And if so, what do you need to do to ensure you don't end up in hot water or in questionable legality?

Any advice is great.

Posts about getting a pump or other SA aren't helpful, thanks in advance!
 
It should be OK to transport into MD as long as it is unloaded and secured somewhere like the trunk. The big transport bugaboo in MD concerns handguns. "Regulated" long guns are generally OK as long as they are NOT loaded or have any ammo in the internal magazine. Some (most?) MD LE officers think a loaded detachable magazine is illegal, but we dispute that. And it is legal to POSSESS regular capacity magazines >20 rounds in MD; you just can't buy, sell, or offer to sell them while in MD.

MD has some weird laws. No rifle shooting in most of the counties? The land is too flat?!?!? Tell that to the Floridians who aren't used to seeing hills at all!

You cannot bring an 'assault pistol' (specific list of such guns, google will find it) into the state if you did not register it with the MSP before '96 (94?), but anything else can be brought into the state for target shooting.

The no-rifle rules apply to hunting, not target shooting.

First, I'm no lawyer and wouldn't give legal advice.

You might review the list of assault weapons defined in Maryland law. The Maryland State Police maintains that list here. That list doesn't contain the Siaga shotgun. It does contain "Avtomat Kalashnikov semiautomatic rifle in any format" with my emphasis on "rifle".

Where it is legal to hunt with a rifle, you may use any rifle that qualifies provided you do so in conformance with Maryland hunting laws. For example, there are limits to the number of rounds you may have in your rifle's magazine, but not a limit on the capacity of that magazine for hunting deer. If you are hunting deer, there is a lower limit on the power of the rifle (and ammo that you may use -- I believe, but am not certain you may use a .223 rifle, but certainly not a .22 LR rifle.

You might contact Maryland's DNR for official rules. Getting opinions, such as those I give you, might get you into trouble. Better from the horse's mouth.
 
For clarification( and I have check this ad nauseium). With the exception of Montgomery and Baltimore Counties which guns are illegal for all hunting) Parts of Western Md are rifle zones for hunting, everywhere else is shotgun only for hunting deer. I have an letter from the DNR stating that it perfectly legal to use center fire rifles to hunt any other animal aside from deer (in season) in any county aside from the 2 listed above. So you could use a .50 for groundhogs anytime of the year if you pleased. As far as local ordinances for rifles, I know of none that have been legislated. Obviously home owners associates may have an issue with a 30-06 going off in a housing development. So target shoot away.
 
As an aside, MoCO does allow hunting with shotguns, but (1) only in the upcounty areas outside of a specifically defined "urban zone," and (2) with the permission/approval of the hunting area by the MoCO PD.
 
§ 5-101(p) Assault weapon.- "Assault weapon" means any of the following specific
firearms or their copies regardless of which company produced and manufactured that

It says AK-47 in all forms. I'd say that includes a 12ga AK-47.

One could argue that any AK-47 is only 7.62x39. AK-100's are 5.45x39 and There aren't any Avtomat Kalashnikov-47's chambered in 12ga, only Kalashnikov based receiver 12ga.

But you don't have to, as anyone who legally owns one can bring it in for hunting without any problem (MDShooters.com). In fact the S12 is legal there, but owners have to wait 7 days after purchasing to pick it up.... The law only get's concerned with it again when you go to sell the gun.

At least that's what our MD brothers say.

The Democrats run Maryland, what more do you need to hear?

Yeah, I'm glad I moved away from there (not that Michigan is all that much better).
 
Here in the Peoples Republic of Maryland you can pretty much only get a CCW to protect large cash deposits, but not your life or your family's life. But they are getting somewhat liberal with hunting laws.

I guess that's to be expected from an ultra-liberal state.
