Gun from Friend

I live in NM. Several of my friends have just been reintroduced to shooting and we are loving it. My best friend bought a self defense gun. Then he bought good target gun. Then a collectors gun and spent way too much money. Then he was bidding on a gun and entered an amount that he never expected to win with and he did.

That gave him (3) 22's, of which he didn't need, and buyers remorse.

I had my eyes on a Buckmark almost just like he bought and my local dealers are having a hard time finding one for me. Nothing prevents me from owning a gun. He offered to sell me his for exactly what he paid.

Is this permissible?
 
Yeah, if you're legal to have one. Always good to get a bill of sale, one for you and him.
 
Under federal law, if it's legal for you to own a gun, this sale is legal. Under NM state law, I don't know. Some states do have restrictions (such as California requiring that the sale be processed through a firearms dealer) that would restrict such a sale.
 
as long as he did not bye them with the intent of reselling he should be ok under federal law. buying something and later deciding that it was not a good idea and selling it to get rid of it is no issue. the issue come with the intent of the original purpose.
 
No he had no intent on reselling it. It was a matter of going overboard. I spouted off about him selling me the Buck Mark because except for sight hoods it was exactly what I was looking for and having a hard time finding. He said 'you know what... I will sell it to you for exactly what I paid because I don't need 3 - 22's and I'd like to get the wife a 380 or 9mm.
