Happened Saturday -- what would you do?

On Saturday, my neighbor and his wife went fishing. Upon return, stopped to fill the boat's tanks. Wife went into store for coffee while husband fills tanks. A car pulled to other side of tanks, male driver stayed w/car and 2 women went into store. Nobody noticed one another.

As neighbor finishes fueling and wife returns with coffee, male from other car attacks from behind w/choke hold and punches. Neighbor, just had knee surgery (3 weeks ago) and heart surgery 4 months ago, and they fall to the ground. But neighbor fights back. He is on ground, on his side, on top of his carry piece (he is licensed for CCW in this state.) He can't get to the gun.

His wife dumps hot coffee on attacker's head. Only effect was to aggravate the attacker, who rises and punches her in the face, breaking her nose. Attacker goes to open driver side door of his truck and reaches under seat with left hand as neighbor, unable to get to his feet, retrieves his derringer (Monday he upgraded!)

Now, what would you do? The attacker's back is turned and he is not (for the moment, at least) assaulting anybody. But, you're on the ground partially disabled and wife is on the ground with face covered in blood.

I'd love to see your thoughts. AFter a few of those I'll tell you what he did and how it all played out. I hope that's okay w/everybody; thought it would keep us from second guessing him too much.
 
that's a tricky one. I know by the law, should NOT fire unless he turned back around with a weapon.

I don't know what I would do.....but to be law abiding, I'll say I wouldnt fire. :)
 
I'd have probably waited until he turned around with weapon in hand.

So what's the rest of the story? Did the bad guy get shot or did he run off when he saw the derringer? Inquring minds want to know.
 
Well, the BG was using lethal force(fist). A well placed hit to the temple can kill a person. So, I would for sure want to neutralize him.

Of course, it is impossible to say what I would really do.
 
I would have shot him or waited for him to turn around and shot him. You are wounded , wife is injured. Attacker is reaching under his seat. Not trying to get away. You were in fear of your life. BAM .........BAM BAM. opps forgot Derringer squeak ........squeak squeak...............lol
 
I'd draw a bead and wait for him to turn around. If he comes up armed, I'd fire. Of course, it's impossible to say for sure until you're in the situation, but that's what I think I'd do.

We don't know the location of the incident, so we really can't say what constitutes lethal force, or the laws pertaining to it.
 
Wait to see what he's bringing out from under the seat with a bead on him.

How old is your neighbor? Having read he's had heart surgery recently one can assume he's "older" and the age of the assailant is younger,older? The fact he's had heart surgery first and knee surgery recently he's not in the best shape to be rolling around on the ground with said attacker and the fact the attacker is rummaging thru his truck for what,paper,pencil or maybe a pipe,knife or some other weapon? Take the shot and let the court figure it out,more then likely considering your neighbor's psychical disadvantages,he'd walk. In Ma if you attack such a person your ass is in deep stuff.
 
Shoot. No question.

He's already assaulted me, and my wife after her attempt to come to my defense. He's at his car reaching under the seat for what I can only assume is a weapon. I am unable to retreat. I am unable to go to my wife to assist or defend her. I fear for our lives.

I take advantage of the opportunity and take the shot offered.

Being assaulted is life and death, not ballroom dancing. The concept of a "fair fight" has nothing to do with preventing someone from murdering you.

But then, as I've said before, Kipling had it exactly right in that we women are more practical about such things.
 
A physical assault was just visited upon myself then my wife? If I could shoot I would assuming that one could still have it "together" enough to respond.

That they "paused" in the attack is of no matter at all since they have already demonstrated a willingness to assault.

(as a side note, two of my "highest alert" locations are ATM machines and gas pumps).

I dunno. He turns around with a shot gun, would you trust to drop him with a Derringer?

Incident occured in East Central Florida.

Neighbor is in mid 50s, wife a few years younger. Attacker's age unknown, but younger by a few years.
 
When he turns around with a weapon in his hand, hit him where it hurts.
In the nose, or between the eyes.

shoot, shoot until the gun is empty, then reload. If threat has neutralized, stop shooting, and call the call the cops, if threat has not been neutralized continue to shoot. Then call the cops.
 
It seems likely the guy is reaching for a weapon. With a derringer, I don't trust it to stop him very quickly, and the guy's had heart surgery and is in no condition to be rolling around on the ground. I think waiting for him to turn around is too big of a risk.

(BTW, this shows the importance of training in martial arts. It sounds like the attacker had your neighbor in "side control".)
 
me being -old -bad heart -recovering from surgury -beaten from behind to the ground -the wife attacked.........what was the question again?
 
Shoot to end the violence.

Sounds like the proper course of action to me. Disparity of force makes it highly likely that even without him going for a weapon he could cause life-changing damage or even death to your neighbor quite easily. Plus if he is going for a gun, I bet it's a more functional weapon than your neighbors derringer.
 
I would shoot him .then if he turned around I would shoot him two more times..[ I dont carry a derringer..]..and then I would run him over with my wheelchair...jcb
