Will AWB2 Cancel Undelivered Orders???

IF there is another AWB (which is definately not a given), it will PROBABLY go into effect on a given day, and any rifle that is not constructed by that point will be subject to the terms of the ban. They won't care whether or not you placed an order, if the gun is not assembled on that day and that time, it would be subject to the new law. However, it all depends on how any hypothetical law is written. Some versions of the 94 AWB had confiscatory language- that is, any AW, no matter when it was built, was illegal and had to be turned in. That sort of thing is still possible, of course, but significantly less likely than a ban of further manufacture.

What's interesting is that the Obama administration has always had renewal of the AWB as a plank in its platform, but until Holder opened his big mouth, they had been very unwilling to talk about it. Now that Holder has mentioned it, the Dem leadership in Congress has said they won't go for it. While none of this makes me complacent, it does mean that there is a very good possibility that they'll do nothing about it until after the midterm elections, and maybe not even until Obama's much-hoped-for second term.

Even assuming Son of AWB, no-one can magically know the provisions, loopholes, does and don'ts, the question is inherently unanswerable.
 
And no, he asked a legit question. We won't do further political discussion, but asking about how an AWB would affect existing orders is a good question.

There is no way to know. In fact there is currently no ban or bill in serious discussion at this time.

Now looking back at the 86 machine gun manufacturing ban there was a majic date that no rifles could be produced after.

Hopefully there will be no "ban" let your congressman know how you feel & support the NRA, GOA, ect.
 
If it's like AWB 1, your serialized receiver will be considered the "pre-ban" part. Thus you would receive your "pre-ban" configured receiver before that date. Even if your gun was never assembled as an AW, the ATF would have no way of knowing that. In addition, they would lack the funds to find out if it was configured as such anyway. If you already paid for the gun, it's essentially yours, pending a background check.
 
Regardless of the details of any ban-bill, whatever is banned cannot be sold after the effective date. Or, cannot be manufactured after a certain date. Or both.

So, if a manufacturer could not by law sell any banned product from inventory, he'll stop production soon enough that his inventory is zero by the ban-date. Distributors and retailers would also try to be sold out by that date.

If the ban-date is ONLY for manufacture, history tells us that manufacturers will go hair, teeth and eyeballs to have a big inventory built up before that date, since sales could continue. That was the case, e.g., for drop-in auto-sears for ARs back in '86.
 
Also, the ban would almost certainly not be complete. I mean, cops and soldiers will be buying ARs afterwards, so even if there was a ban on sales to civvies, any excess inventory could probably be routed in gov't sales. Just to confuse things more.

In truth, though, you have your answer. The law ain't been written yet, and hopefully never will be written, so you can't know what it will say.

The Dem leadership didn't say they weren't for it. They just weren't happy the AG said it before they did and poo-pooed it off until later...
 
Well if/when the ban comes and if I have an order, I would contact the company to get the compliance parts immediately (like the lower receiver) and then worry about building it with the remaining parts later.

But as others have pointed out this is speculation because we don't know if/when/and what the ban will do.
 
Coronach is probably right. My personal take (though there is no real way of predicting any unwritten legislation):

If it has been constructed but not delivered, it would not be delivered (to civilians). If you have not taken possession of something by the date of the ban, you will not ever take possession of it. Of course, all this is also based on the idea that what is currently out there (in civilian hands) would not be confiscated.

BTW, Eustachius234 - the link in your sig is a little "out there." I'm way into states' rights as well as "mixing up the mess" but seriously?
 
When they closed the NFA registery for Mguns, some manufactors when as far as sealizing unmachined stock so that it would make it before the close of the registery.
 
when the ban comes people here ( Hawaii ) who ordered an AW may have bought it but we won't be able to register it at the police dept. Yeah we got strict laws here! We are being controled :barf::banghead:
 
Maybe this is why the prices on everything has tripled. I was gun shopping and business was brisk. In a 15 minute time span I noticed 4 AK variants get sold. Funny thing, rifles went out the door but the shop had no ammo to sell.
