Hello everyone,

I am new to this forum and recently a new first time gun owner. I hate to ask for help so soon, but can someone please tell me where I can find the msrp for a xd9102 and xd9109?
I was told i purchased a xd9109 and this is what my paperwork says, but after I get home and I'm looking at it i have a xd9102. The best I can tell the only difference is the sights. a 9109 has night sights and the 9102 does not.

I called the place I bought it and they basically said take a flying leap. So I want to find out the msrp price difference between the 2 guns to further my complaint against them.

thanks for the reply. I found that also, but I noticed the prices were from '03. I think I found my answer on the gun source. Or at least I found another source. The bottom line is there is about a $60 -$70 price difference in the 2 guns.

I'm more concerned about my paperwork saying the wrong model number than I am about the money at this point. Since I'm new to all this I don't know if this is a big issue or not. The serial number is correct, but the model number is wrong.

I plan to go back to the shop tomorrow in person and talk with the management to get this straightened out. The guy I talked to on the phone told me they don't pay attention to model numbers because they just charge the same for all xd .40 cal :what: I find that hard to believe.
 
I think you have good reason to be unhappy. The gun you asked for was not the one they sold you, regardless of the price. I do have a little bit of a hard time believing that they "don't pay attention" to different models when the price difference is 70 bucks. You may be in a little bit of a pickle as to what you can ask for, most (if not all) gun stores will not take a firearm back once purchased. You may want to look at what you were charged compared to what you got, if they charged you for a 9109 but were given a 9102 then I would expect them to pay for a set of Trijicon sights and the labor to install. If you paid for a 9102 and were given a 9102 you may just ask them to pay for the labor to install said sights that you purchase. Some of the blame does rest on you though, ultimately it is you that must make sure the firearm is exactly what you want before you leave the store. I had some shadester at Cabella's try to slide me a 92FS with two 10 round magazines in the middle of the gun ban when it was supposed to come with 1 10 rounder and one hi-cap. I raised a little bit of a fuss and he magically produced the correct mag, almost like he knew exactly where it was. He was pretty pissy about it though.
 
agreed most the blame does fall on me for not checking over everything. This is definitely a lesson learned.

As for the price I paid $580 for it and from what I can find that is roughly the price of the 9109. The 9102 is down in the high 400's to very low $500's from I have found online.

keep in mind this was my first gun purchase so I had no idea about the different models when I was sold the gun. I liked the safety features the gun had and it was recommended to me to get a .40 cal. This was the only gun they had that fit these 2 requirements so i bought it. It wasn't till I got home that night that I went on line to see what I actually bought. The first thing I noticed was the night sights and i thought cool my brother-in-law had just showed those to me on his gun. So after my 2 weeks go by waiting to pick it up I bring it home and that night I pull it out of the safe to show my wife and I said look at the cool glow in the dark sights ... turn the light off and nothing :uhoh: then I look on the case and notice its a 9102.

I don't expect to return the gun, but like you said I do expect the sights or a refund of the difference. Or at least a oops we're sorry we messed up. Get lost just doesn't go over well with me.
 
Why did you have to wait 2 weeks? Lay away? Waiting period?? If you paid for it 2 weeks before you picked it up and your receipt said you bought a 9109 I wouldn't take anything less than them paying for and installing the sights, especially when the amount paid seems to indicate you paid for the model with the Trijicon sights. If they tell you to pack sand, you may want to consider small claims court. I had to go for work once and was pretty impressed, actually, it was fairly down and dirty; both sides told their version and the magistrate said "this is how this is gonna end". I thought it was quite fair and rational, not like the B.S. you see on T.V. and you can get the $35 bucks back that it costs to file.
 
Well, I didn't want to name drop before I had a chance to go to the store and talk to them in person. I just got back and they told me to go kick rocks. So thanks "The gun room in elk grove, ca" for the major screwing over and horrible customer service! :fire:

I asked why does my paperwork show xd9109 as the gun i purchased and I got a xd9102?

Answer : the model number means nothing we just pick one to fill in the paper work.

Question #2 : Msrp on the gun I got (xd9102) is approx $80 less than what I paid, but consistent with the price of the xd9109 which my paper work says I purchased.

Answer: we charge over retail because we can

This is just bad business no matter how you look it!
 
Well, you are in the digital age my friend... Google the store's name and then leave a negative review of your experience anywhere they let you. Dex, yellowpages, citisearch... Small businesses quickly learn they can't treat customers like crap and have no backlash. I read reviews on everything before making larger purchases and others do to. You can put a damper on their business if they don't want to treat you fairly.

Just be honest and fair and let them deal with the consequences of their practices. There are plenty of gun shops to buy from with good reviews, that it will detract customers from them.

I do this with car shops too. I let them know that if they do right by me, I will post a good review on my car club forum. They can do the math themselves for what happens if they treat me poorly.
 
From what I see every time i am in a gun shop anything with night sights cost more than the same gun without them.



The bottom line of whatever they put on the paper work or what they charged you, if you bought an xd9109 and the gave you an xd9102 they made a mistake and need to get you the right gun.

I would go back and say looky here bud and I would have done it the first time.
 
Sounds like a material misrepresentation to me. Telling someone (on official paperwork) that you are going to sell them product X and actually giving them product Y is not just "bait and switch" but is actually a form of fraud.

Were I in your situation, I would send them a certified letter laying out the facts. Explain your position, and end the letter by asking for them to perform a specific action within a reasonable amount of time. (10 days, maybe.) At that point, if I had not heard from them, I would file suit in your small claims court. As mentioned above, it is a fairly easy process that will take a month or two from start to finish, at least in my county. (Orange County)

Let them explain to the judge how running a model # through DROS that is inaccurate is just what they do for record keeping purposes. They won't get very far.
 
I'm still curious about this waiting period business and how it works. Did you go to the gun store, say you wanted a 9109, pay for a 9109, get a receipt stating you bought a 9109, then come back 2 weeks later and they pull a gun off the shelf and fill out the paperwork? Or do they complete the sale and set aside a specific gun on your initial visit for you to come pick up 2 weeks later? I'm curious at what point they handed you a different model than you were sold. Did you go there and ask for a 9109, or did you go in and let them help you pick out a model? Did they say or imply that it had night sights?
 
This is how it went. I go to the store to buy my first gun. The guy asks what i want to use it for? .. I said home defense. He recommended a .40cal ... I said ok. His next question was how many safety's do you want? .. I said as many as possible because I have 2 small children. He said I recommend the xd ... I said ok I'll take it. he takes the gun off the wall fills out all this paper work, puts the gun in its case and the gun goes to the back room. After more paper work (about 45minutes to 1 hour in total) he said I can come back and pick it up in 13 days (CA law).

When i get home i pull out my paper work to look on line at what I actually just bought. I also looked up prices and it seemed I got an ok deal. It was higher than I saw on line, but only by about $20. I'm still happy and excited to get it.

2 weeks later I go pick it up. again about 20 more minute of paperwork to pick it up. There is a indoor range where I bought it, so I go over there and put 150 rounds through it. I did get my thumb in the way of the slide once and got a nice little gash ... Lesson Learned! All went well ... still happy

That night I pull it out to show my wife and teach her what little I know about it. I say look at this it is suppose to have night sights. I turn off the lights and nothing. Now I'm confused I go back on line and look up the model again thats on my paper work ... it says it includes night sights. The case the gun came in happened to be sitting right next to me. I looked over at it and on the side it had 2 big stickers. One had the serial number and the other the model number. The serial number matched, but the model number was a 9102 instead of a 9109. So I looked up the 9102 and it does not have the night sights and its $60 - $80 less than the 9109 now I'm :cuss::banghead::fire:

I cooled down and figured oh they just made a mistake I give them a call to get this straightened out. And you have heard the rest already ... they told me to go kick rocks!
 
If I would have went in there and they sold me the 9102 and thats what my paper work said. Then shame on me for not checking around for a better price. I'm going by what my paper work says and it says 9109 so that is what I expected.

Either way I'm still happy with the gun, but needless to say I will not be going there again. I have already contacted CA DOJ and I will be contacting the BBB just to let them all know what is going on over at THE GUN ROOM in elk grove, ca. So hopefully the same bad situation does not happen to someone else.
 
I think you've handled it about as well as you can, it really boils down to how pissed you are about what you were charged. If you would have went in and said "I want the XD with night sights"; I wouldn't blame you for being much more motivated to make something happen. But really, it sounds like you went in there and they shook a few more nickels out of you pockets than they should have since you let them recommend a gun. Really, all your out is 80 bucks, it happens to all of us at some point; at least you didn't go there to buy a car! Think what that could have cost. You might be surprised how well the BBB complaint can work out, if they are a member of the BBB it wouldn't surprise me if you got the difference in msrp back. I had an issue with a mortgage broker once, the BBB got that problem handled FAST after I tried shaking all kinds of tree's in that company for a solid month. Key is if they're members of the BBB.
 
Follow navraster's advice, and also lodge a complaint with the BBB. Leave feedback/reviews of them wherever you can online.

This is the beauty of the free market. Bad companies can be made to change (or be put out of business) by the consumer.
 
Are there any serial numbers in the paperwork for the gun? Do the guns match the serial numbers?

Most paperworks for applications includes specific serial numbers to go with the model numebrs.

If they were sloppy enough to give you the wrong serial number for the paperwork... well, there is a lot of things you can do to them for that. (a ATF call threat, for example..)
